Its more for liability reasons on their end. You can't sue them what not for your car not passing emissions or inspection.

You can have JB4 installed. However, be wary that if you car has mechanical issues and BMW catches you with it when you bring it in to get it checked out, you warranty will most likely not cover the issue/ repair.
