Is this 75th and stony island in Сhicago? From the picture (google maps) 75th street it is only a 2 lane street each direction, how in hell did she managed to plow into the side of you, was she trying to cut you off on the right? In either case, there was no turn only lane, but of course other driver can lie and say you went from first lane right and cut her off. I say wait for a little bit and if crap keeps going down, either go through your insurance or get a lawyer.

As for the car it might be close if not to total loss as what is your car valued now?

Good for her. I'd consider myself an aggressive driver but if people are going at least the speed limit, I'm content. I would never hit someone while high on painkillers though. It's scary that people like her are on the road.

Yeah it is the 75th and Stony island in Chicago, the area is mad ghetto but I am currently doing medical rotations at Jackson park hospital there. The driver is saying that I cut her off and hit her when I was changing lanes which is why insurance is giving me a hard time. They haven't seen the police report yet but you are right the officer shows it as a one lane street as opposed to a two lane street for some reason. That sucks the officer because it decreases the officers credibility which hurts my side of the story.

My car should be worth only like 12-13k because of the high mileage. It still looks pretty nice for a 12k car. So I would like to just keep it rather than get 12k with which I can't buy much with.

Ah I guess time will tell. I might not get anything and have to repair the car myself which would suck. Accidents suck, especially when you have liability insurance only on your end.

Damn, if you have only liability insurance it could be bad as if other person's insurance decide not to cover it, you will have to repair it yourself. Are there any cameras in the area (looks like BP and Jewel) or any witness of the accident?

As usual in accidents people always lie, hopefully you have taken lots of pictures.

I think all the stores are pretty far but I guess its a good idea to go there and ask them if they have any cameras there.

Is that not enough to total it? I think I would prefer a check, depending on if you're attached to the car or not.
A lot depends on insurance. Some will total after 50% of damage value others like mine over 65%.

This is what is on the police report:

From just reading the police report is is quite obvious which car is at fault. I am car 2 and the other driver is car 1. I hope the insurance company covers my damages. The body shop just called me today and said the repair expenses will be 6000-6500 and there is suspension damage underneath the car from the accident. Sorry guys I just needed to vent.
Yes 6500 it's a lot. I guess. My insurance gave me $10,500.

so the other persons insurance company denied my claim because there was a "witness" brought by the other driver that saw the accident and said the back side of my car hit the front of the other drivers car. I'm so pissed I don't know what to do right now.

With the way the police report is written, I would think all you have to do is prove you had your right turn signal on.

She is not supposed to pass on the right in the first place. Officer even wrote that it is a ONE LANE intersection.

I'm going to go the hospital on Monday where the accident happened and ask if any medical students there witnessed the accident, I remember there were a handful of them at the intersection waiting for the bus.
