Dealer negligence while under warranty?

Curious to have the folks here comment. I was taking a look around the engine bay and noticed that the power steering pump has a small leak coming from the junction where the main hose meets the pump on top. From the grunge, it seems to have been leaking for a while.

I just bought the car last November and saw that the previous owner had taken the car to BMW, while under CPO warranty, to complain about noise when turning. From the BMW report it just says that the tech "noticed that the fluid was low and didn't see any leaks" then topped off the fluid. Can a car be low without leaking? It doesn't seem like they actually cared enough to inspect.

Occurred: 51k miles.
Now: 63k miles.

Maybe I am reaching, but I feel BMW should be somewhat responsible...

Either way, I am going to have to replace that hose.

I think you are on to something. I would bring it up the leak with the service history. The worst they could do is dig in and say no, but I think their technician might have missed this problem during his inspection.

Based on your description I'm guessing it's the expansion hose (part 3 in the diagram above). It it leaking from the crimped end fitting on the hose or the banjo bolt? Got a picture?

That's an expensive hose and they'll have to replace all the fluid...

Is it leaking from the hose junction or from the banjo bolt between the pump and the connection. May be they have not replaced the crush washers or did not tighten it fully, although why would they disconnect to change the fluid, if they did at all. Probably not, as its another "lifetime fluid".
