This whole thread has me chuckling a bit. I live in a neighborhood with an HOA and I would not want it any other way unless I lived on a large piece of property. I am also on the HOA board which is an elected position. I also like to point out that no board member gets paid a dime for their time. The HOA and the board of the HOA is there for one reason only. To protect the home values of the residents based on the covenants which have been established. As a board we do not pick and choose which of the covenants we are going to enforce or ignore. This creates way to much ambiguity and could show some type of favoritism. So when we review violations which are brought to us by our management company we always look at them objectively and when we are on the fence the last question we ask is, "does this retract from other residents home value?" I will say we have more issues with rental properties than we do the others. Thankfully we do not offer lawn care as an option as the lots are too big ranging from 1 acre to 12 acres in size.

I laugh my ass off when we are accused of being power hungry. Not a single member of our board needs power. I can also assure you that the last thing I "want" to do is deal with an ARC request or covenant violation. There is a million other things I would rather do with my time. That said, we will not give in to shit heads. We will stack fines on your until you get your shit straight and eventually put a lien on your property to ensure the residents are compensated for your selfishness.

Don't even get me started on people poaching fish from our lakes.

My advice is that if you don't like covenant neighborhoods then don't buy a house (rent) within one. We love ours!

You claimed they damaged your car and they disagree. No shit they are going to make you move it so they don't have to worry about liability. I'd insist you did the same.

You can either be a dick and refuse to move it or go buy a lawnmower and cut your own damn grass. Problem solved. FFS some of you are dumb as rocks.....

Are said fines even LEGAL? For example, let's some someone complains about their neighbor playing music/TV too loud. Let's even go beyond that & say the complete was just from a dope & there was not excessive noise, but the HOA just fined the person b/c of whatever reason they wanted. Re-read the story. This is not a move car issue. NO ONE HAS TO MOVE THEIR CAR. Also, my complaint was 4 YEARS ago & I did not pursue any action against anyone. Our HOA does not handle noise violations. We also do not react to complaints just on someone's word. It has to be a tangible violation that can be verified.

The HOA can:

Issue fines
Put a lien on your house
Force a bank foreclosure if the debt gets too large or old.

Homeowners agree to association rules and fines when buying their home and joining the association. They also elect the board who hires the property manager. Usually homeowners also must agree that guests, including tenants, will abide by the rules. I don’t think loud music is typically one of the rules (maybe in condos), but there are local laws and neighbors would more likely call the police when there is a disturbance than complain to the HOA. Violations cited by the HOA often arise from the property manager driving through the neighborhood.

The rules are usually about things like property maintenance and avoiding eye sores, types and numbers of pets, paying dues for common area maintenance, etc. Hence your issue. Grass cannot be cut because of your dispute with the landscape company. So they either want you to move the car so the landscape company can do their job or cut it yourself. But leaving the yard uncut isn’t an option. And yes they are enforceable since they are contractual and liens can be placed if fines are not paid. But the issue will really be between the HOA and your landlord. If you have a security deposit you could lose it, or you could get evicted, if you actually let something so simple escalate and your violations of the lease result in fines to the landlord.

Most homeowners associations have the right to place liens on the houses of homeowners who do not comply with the CC&Rs.
