If you could pay cash for the full price, why not custom order a 2011, and finance a very small left-over amount? This must be a company vehicle/corporate fleet.

You could have the fun of a brand new car and custom build it to whatever specs you like. Considering ~40k as cash, you should try to get full 4 years of warranty. JMO

I have seen 2009 fully loaded 328s for as low as $33k search online, but I would think that 33-35 is reasonable.
