Hey I thought I'll piggy back on this thread, just got my first ticket ever as well, 50 over 40; so which box did you check for defferals when sending the ticket in (mitigation hearing or contested hearing)?
Do I need to talk to lawyer, I am usually a good boy on the road

Third box which says "I do not believe I committed this infraction and I want a contested hearing." When you go to court, the judge will explain the deferral process and when your name is called, you go up there and tell him/her you want a deferral. The only two places where you have to take a deferral prior to a contested hearing is Seattle Municipal Court and Kent Municipal court. The whole purpose of paying for a lawyer is to prevent your insurance from going up. Yes, you pay more when you hire a lawyer, but if you get tickets on a regular basis (such as myself), hiring a lawyer is a good idea. I am a criminal defense attorney who also do traffic tickets on the side. Many of my esteemed colleagues and friends have been mentioned in this thread. Hire any of us and we will get the job done. Our position is this: You get one deferral every seven years. Save it for the big one

Thanks for the post Phil, yep that's what I thought the cop told me after he gave me the ticket, to contest, but a co-worker told me to check the other box. My logic tells me I don't want to contest any cop w/o representation.

Hey Phil Su, I've heard from a couple friends that getting pulled over for no front plate/ dark tint, is a secondary offense and you police can't pull you over just for those reasons. Is this correct?

Also, in my case, I got pulled over for speeding. But the cop had no proof other than "he couldn't catch up with me." Instead, he tickets me for no front plate. I was told he can't ticket me for front plate, unless he also tickets me for speeding which is why he pulled me over.

Sorry Vincent, that's not the case. Window tint under RCW 46.37.430(7) makes it a traffic infraction. It does not say it needs to be secondary offense. As for front license plate, the goes like this: If only one plate was issued to you, then you need to affix it to the back of the vehicle. However, if two plates were issued to you, you need to put one in front and one in the back. An officer or a trooper can pull you over for having no front plate and he/she can cite you. I don't think it is a secondary offense. However, cops can cite you all they want, it does not mean the citation and affidavit will be sufficient in court to get a committed finding.

I just got a ticket going 80 mph on the hwy (limit is 65) in San Jose, CA.
My address on my ticket was also wrong so my total ticket cost is $1,026.00!
Speeding violation is about 450 plus $308 for traffic school ($760!!!).
And for my correctable address change, it's ~$250!!

Be aware that asking for a deferral or traffic school is NOT guaranteed to be granted by the judge, even if you qualify for it. So don't think you can casually go in without representation, go through the motions, and be granted a deferral. Maybe, maybe not.

If you get an attorney: most attorneys will try to use your deferral or traffic school as their first option, if it's available. It's a bargaining chip.... it's easier for both the attorney, and for the court (because the attorney will otherwise take a lot of the courts time, submit evdidence, ask for witnesses, radar calibrations, etc..).

Don't feel cheated if you pay your $350 attorney and they use this: they've done their job imo.

Lastly: expect a bill regardless. typically if you have something like reckless driving, you should expect to pay the attorney, as well as some fine.

I'm embarassed to publish how fast I was driving when caught (it was a saturday early morning, no other cars on the road fwiw)... but after using a traffic attorney I ended up paying the attorney fees + a 'municipal fine' of a few hundred dollars, and it was not reported to insurance. And I didn't have to take time off to go to court.

During my late teenage yrs, I got a "misdemeanor" ticket for trying to outrun a bunch of cops that caught us "attempting" drag racing - 2001 i think. I was asked to get an attorney, I cheap out and got the free ones because I can't afford one. Since I wasn't actually racing, but just merely trying to run away when the cop arrived because I panic, they drop my ticket down to speeding (+2points and driving school). Never did any crazy shit after that.

That said, unless you are endangering anyone, you should be able to get your ticket waived or reduced for first timer.

To prevent the ticket all together get a radar detector that sends back a surge signal to the radar gun causing it to short and catch fire. Then you wont ever have to worry about speeding tickets. I don't know of any out yet, so maybe someone could draft up a plan and make one.

It can take up to a month of sometimes longer. When I got my ticket in October, they kept postponing my court date and I didn't get a date untill February. I won the case though.
