ALOT of things happened and changed for the worse over the course of the GB. if you are going to excuse yourself of the 3month delay, you have no right to say no to a slight change of plans in BMWE90's situation. grow a set.

I'd like to offer my comments here and please remember that I am acting
in a neutral way and I am not taking sides. I'm trying to look at this in an
objective way.

To be honest Felix and BMWE90 are both right and wrong at the same time.

Felix is right and BMWE90 wrong because you have to consider the agreement
like a special deal - imagine going to an airline and buying a ticket and that
costs say $120 but they says "for you and just for you and because we
inconvenienced you, we will do it for $100". Mind you this price is for YOU
only and tickets of course are not transferable. You call them up later saying
that you backed out of the buy and instead you put someone else in your
place. You speak to the manager and he tells you "sir the deal of $100 was
for you only so if you want someone else in your place, the price will be $120".
Mistake here from BMWE90 is that he should have asked Felix first if he can
do that and if Felix will honor the free shipping in this case. Mistake of course
in the first place was that he made his sell public as well without having the
ok from Felix that he will honor the free shipping to someone else.

BMWE90 is right and Felix wrong because it's nobody's business what BMWE90
is going to do with the lip after he receives it. He may want to eat it, burn it,
shred it, surf with it, beat up someone etc. Felix is bound by the deal to send
it to him free of shipping, he never said that if BMWE90 sells the lip he won't
honor the free shipping, but then again BMWE90 never asked. It also has no
additional cost shipping to the new buyer so it's no big deal. To put it in a
different way it's like a seller asks for shipping money after the buyer gets the
goods and then goes on to sell those to someone else. Kind of unheard of.

So both of you have created a mess out of nothing to be honest and you're
both wrong and right at the same time. I hope you reach an agreement that
satisfies both buyer and seller.

Shadowcoder- I get where Felix is coming from. I get that the agreement was between me and him. However, I didnt get the lip in time before ending up selling the car.

Felix- yes you proposed to pay for half and have BeeEmdubu pay the other half. Now he doesnt want to buy the lip anymore so I have to give him a refund. This means that you have to pay for shipping to me (the whole $70). If you're gonna do that anyway, why not save us all the trouble and just pay shipping to BeeEmdubu??

I didnt want to talk on MSN anymore because I kept having to explain to you. We were going in circles. I wanted to talk here so others can offer their thoughts on this. Im sure others know what Im talking about here. Sometimes we have to reiterate our statements over and over and you still dont get it. I dont know why...

What if BMWE90 did get his lip 3 months ago before selling his car? Then when he decided to sell his car, he decided to part out his lip and found a buyer? Would you make him pay you back the $70 shipping?

As I said in my post that's unheard of. So please lets not drag this thread
down that path.

I think the idea here and the best thing to do is to have some common ground
and be sensible. So try and find some common ground here and discuss and
resolve this because you're both pulling each end of a rope and that doesn't
get you anywhere. And neither will questions like the above because we all
know the answer to it.

felix was supposed to send the lips 3 months ago, then he lied about april 7th shipment, and shipped it on april 24th. Please calculate that into your view. it will all make sense.
