Sounds like you are taking it back, which is wise. No offense, but I think the dealer saw a sucker, and is taking advantage of you. It's no surprise BMWFS is asking for more money, if you are going to be that upside down.

I got mine brand new for $46K OTD with tax title everything at 0.9%. Its a 2008 E90 w/ sports package, ipod, heated seats, navigation... Please don't spend that much money on a used car!

Great posts. You guys gave the OP great advice. I agree:

- it's a buyer's market
- the cars has probably been beat
- the price seems too high
- the trade-in seems too low

If you are going to spend that much, spend a bit more and negotiate a fantastic deal on a new one.

BTW - Don't forget you live in Cali - there is no such thing as a hot, limited BMW here (at least nothing in the current MY line-up)
Except when the z8's came out - those are some damn pretty cars, classic lines

Yes I took it back. They told me to bring it back earlier however the contract says to bring it back when I RECIEVE the notice to rescind in mail so i got my 2 extra days with the car haha

Yes they had my old car, was a little dusty but it was all good. They didn’t have my down payment ready to return and need to cut me a check so I didn’t sign any thing for them stating that everything was "complete" or back to status quo.

The sales guy was getting upset, after all he didn’t end up selling a car and he was upset I kept calling the car USED... Well if he didn’t think a demo was USED before it is certainly USED now! 160 on the drive to Vegas was fun

Feels good to get out of a deal where I was almost getting screwed over, thanks for your feedback everyone! This story has a happy ending and I ride off in my 03 325i into the sunset

Where do you guys pay like $500 over invoice? The sales guy I talked to at the dealership balked at the thought.

If you are serious about buying a new car, I recommend you figure out exactly how you want it configured (including packages, options and colors) and then call about 6 dealers in your area. Tell them what you want and ask them how much they want for it.

By the time you get off the phone, you'll know if anyone has the car you want, how strong the demand is and approximately what you'll have to pay. You might get the deal you want after one hour on the phone. If not, you can expand your calling range and this time you'll know exactly what you want to pay.

Given the sick economy and even sicker car market, you should be able to get a great on almost any car these days.

do a balance transfer with your existing auto loan onto a no-interest-for-12-months credit card... that will give you time to sell it private party for much more than 7500 and in the meantime wont through your crdit/income:debt ratio as far out of whack. put 5k down on the 08 and eat the higher payments or baloon a 30% residual
