if your warranty is voided, can't you just seel the car and get a new one for the same price, basically?

Exactly.. I thought it was just an exhaust. Now you mentioned aftermarket exhaust and DP of which one (or both for all we know) are catless. Whether they're at fault or not (not), you are just asking for a warranty denial.

While I agree in some ways..BMW NA made the decision, not the dealer. Since the dealer is incompetent and had to open a puma case, the info was then transferred to BMW where the decision was made

There are many of us in your situation. I feel for you. I've got a year left on warranty, but I don't expect to place any claims considering the modifications I have. At this point I've bit the bullet on holding the bag for any issues.

Crossing fingers, knocking on wood, holding my rabbits foot, and hoping the lucky horseshoe stays implanted.

PS: I'm enjoying the heck out of the car, way more than if it were stock.

I'd still just buy a new one... and put my mods on it.... other than having to pay the taxes again... there's not really any negatives to this. I mean buy a equivalent used one... all of em depreciate about the same...

If it's blown turbo with no cat, aftermarket DP and exhaust, BMW may not be so generous.
above scenario is a conclusive FAIL -- toss youre arguments aside and pull out your wallet...

Say that you want a lawyer. I asked my dealership and they said that they have to prove that it was caused by the aftermarket part. They said that I'd lose my warranty for the 'exhaust' if I change it, but I'd still have my engine warranty. As long as the cause of the problem was not the exhaust, they should cover it. Sue them!!

In addition the MM Act applies to direct replacement spec parts only, not to components designed to "alter" the vehicle in any way. Removal of emissions devices are illegal and constitute "alterations" to the vehicle. Have a lawyer explain it to you if you have questions on the technical and legal aspects.

I do not provide legal advice. Unless you can get a lawyer to work on 100% contingency, take their advice with a large grain of salt however as you'll be paying the bill. In America you can sue for anything but it does not mean that the law will change to suit your desires.

again, if that component affects anything in the intake tract, or the engine .. expect to have it thrown into the equation. if the mounting brackets or any fastening hardware are related.. again, expect to the worst, an hope for the best.

It may seem really stupid, or childish, but the best way to find out how your service dept. handles modded cars, is to ask a open-ended question to service manager, if you can find him/her. this usually will indicate how the advisor will handle the situation.

"hey Chuck, (or whoever) -- Um, what do you think of those XX intakes, do they really give you a performance increase??"

what follows is what to expect if you mod you car.. i'd suggest that every car owner ask these questions -- just to get a feel for shop policies...

Problem is, their policies go out the window once a puma case is opened. Any alterations to the car are submitted to BMWNA, and they decide if warranty is honored or not. My car has been modded for years, and no one has said anything..bad coils, hpfp, water pump, all fixed with no issue.

from my understanding the only reason a PuMA case is opened if the tech has trouble indentifying the failed system or component... and is asking for assistance from Technical, or the component is on a list of items that require a submission prior to warranty approval.

if the tech noted the mod in the report ... then yes, ur up a creek without a paddle.
