Not meeting EPA standards is bad press but not nearly as egregious as developing software to deceive the testing equipment

Possibly,

Or it maybe a scame to sink the shares of BMW to allow some shorters to make a profit....

West Virginia University that found the VW's cheating again (already found in Europe), says that the US X5 they tested was compliant.

So we'll see if it affects US based BMW diesels. I suspect that if BMW can't meet emissions it isn't because of any real cheating from what I've read, but more due to technological limitations.

Isn't the x5 classified differently as the e90 since it's an suv?

Not under the US standard, I don't know about euro. Everything has to meet the same standards in the US from the scion IQ to half ton trucks. Above half ton is heavy duty and they have a different set of regs.

But they have different EGR systems, no?

big vs small

I wonder if the three-legged stool of power-MPG-emissions is easier to balance using a motor with surplus power (3.0L) vs one that you are trying to squeeze power from (2.0L)? Our motors are so tame. Much performance may have been sacrificed (though plenty remains) in order to strengthen the other two legs.

Just thinking aloud...
