wow I'm so :mad: I have been wating 4 my e90 4 more that 5 weaks and you know what the dealer did the sold the one that I order by error
![]() they order another one and the manager told me that they were not going to charge me the dealer fee that is like $550. but now I have to wait for my car again !!! ![]() is this as happen to any of you guys ??? |

There is no such thing as a dealer fee. Additionally, if a dealer made a "mistake" and sold a pre-ordered car to someone else, you might just have grounds for a lawsuit. If this really happened, they should be bending over backwards to accomodate you and REDUCING the price. Sounds to me like they have found themselves a first class sucker.
If you order another car through this dealer and pay them any fee then as far as I'm concerned you give up the right to ever complain about anything ever again. I don't know you, and could be wrong, but you sound like someone that they could get to pay extra for the air in the tires.

dealer mistake???
..5 months ago..my uncle ordered an 06 Range Rover and on the day of delivery we were all excited to pickced it up...on the lot we saw this black RR that was supposed to be his but his salesman and some guys was taking pics with it....moments later we were so shocked to find out from his salesman that his car didnt arrive yet..how could this happen when 2 days before the delivery someone called to let us know that the car is ready on that Saturday....another salesman in the showroom even confirmed that the car is in the lot...is it possible that the moron sold it to someone else? we were so upset that we went to another dealership and bought one the same day...

ledzep is probably right about grounds for a lawsuit- a contract is a contract is a contract, with few exceptions. you should get loaner, at the least. unfortunately, you may have already 'settled' by taking the $550 discount.
sorry for the repeat, but, the more i think about this, i can't imagine how any car gets lost in any car dealer's system nowadays-- let alone BMWs' system where a customer order is priority one. they type in all sorts of junk when you buy a car. they must have known that car was taken. the VIN should've been tagged to your name. if you haven't re-signed any papers, i'd try to get something better than the 550 discount out of it. double-check your price against invoice, negotiate it down if warranted, and get a loaner. |

hey guys thanks for the help, I went today to findlaw.com and I call a lawer and he is going to help me with the problem.
I was so anxious to get my e90, you know how hard it was 4 me to get a loan I just turn 20 and this was the 1st car that I was goign to get by my own. with out any help from my parents. and joes3series I think you are right probably someone came and offer them extra money 4 the car. SUCKS! |

be careful about getting a lawyer-- not because they won't help you, but, the cost can easily get horrendous. lawyers typically charge around 300-400/hr. They will bill you for every minute you spend with them (on the phone, etc.), and some event round it to 15 minutes (i.e., ~75USD for a 2 minute phone call). It may cost you more to obtain counsel than it would to eat the difference. Consider going through normal means first.... i.e., talk to the manager. Make sure you know what you want to get out of it first, then, talk to the sales person. if he doesn't listen, go to the manager.... Even call up BMW NA and ask them about policies regarding ordering- see what they have to say; see if they could help at all. If you have a friend that is a lawyer and he won't charge just yet, that's a gravy train; otherwise, PLEASE be cautious. Make sure to discuss all fee arrangements prior to accepting someone as your counsel. You are young and naive, and both the dealer and the lawyer know this-- don't let them take advantage of this.
Oh, and I didn't think of this before, but, do consider using "fraud" as a buzzword. That might just be what they did, and, depending on a bunch of factors, that might just make any alleged settlement ineffective. Same might go for "mistake of fact." well guys good news I did what joes3series told me thank you joe, I went to the dealer and I talk to the menager and well long story short, they give me 4k off the price so the same car that I was going to buy for 38 is now 34
