Need help, BMW USA Wont

Hey guys,
I didn't know if anyone on here knows anyone with BMW USA. My 335i has gone through 3 HPFPs this year alone! In NC that means my car is Lemon. BMW USA is not doing anything about it, and before I get my lawyers in and pay them boocoo's of money I wanted to see if anyone had a suggestion.

I do love my car, but I own two businesses and do not have time to be waiting around at BMW while my car is being fixed. Recently they put me in a KIA Spectra as a loaner.... ..... That is the kind of service I am getting from these guys.

BMW has replaced my VANOS Sensor once, Fuel system once, and HPFP 3 times. I have gone into limp mode more times then Ron Jeremy! My car just does not want to work!

I have a lease so I feel it will be very easy for BMW to just end the lease (8 months early) and let me walk away from it!

If anyone knows anybody that can help please let me know. PM me or just reply to the post. Thanks.

Don't just walk away from the lease. You should be able to get much of the money that you've paid to them returned or rolled into another car.

I don't know about NC, but the Lemon lawyers here in SoCal are easy to work with since you dont have to pay for any of the costs associated - win / loose.

If the car's determined to be a lemon, they get paid by the manufacturer and if they loose the case, then it comes out of their pocket. NOTE: I was told by several lawyers here that they generally do not take a lemon case where they're not confident about winning..

Google "Lemon laws in NC" and see if that helps you decide if you qualify / not.

Good luck.

Shouldn't cost you a penny for a lawyer....it's lemon.

Lastly....drive it over to Spartensburg down in SC and it in their lot and make sure you get some big wigs around and say "Here's your f&*king lemon!!!!"

Then walk away....

My 08 335 E90 had gone through:
2 Fuel Pumps
1 Set of valves
1 Catylic Converter
1 driver airbag
2 seatbelt tensioners
1 12v dc socket
and a several other things that required me to get a loaner. I was basically in the shop at least every month a few months every 2 weeks, one month every week. Let me tell you it was complete HELL! I almost left BMW to go with a S4-S5. So I e-mailed BMW USA and told them that this was unbelievable, and my BMW is NOT the Ultimate driving machine. Also told them I own 2 brick and mortar businesses and do not have the time. Also, I told them I spent at least a few hundred dollars in gas for loaner cars and driving there, Also, having extra employees coming in to cover, which costs money. I told them I would understand it it were once every 3-4 months wouldn't be so bad but this was not the case. I told them I wanted to be put in a different BMW or Refunded my money minus depreciation from me driving it the first 3 months before it had problems. Also they won't cover cause I was the second owner. (This car as CPO) (I had the car for about 10 months) They said NO and asked if I had any other requests, I asked if I could get a large discount on a brand new BMW and they said YES a week later. I paid $37,000 for it with 13,000 Miles. So BMW USA worked with the dealer to give me a deal. So I got $31,000 Trade in plus BMW USA gave me another $3500 for the trade in towards the new car. I ended up with a 2011 E90 sport package (Fully loaded), Sticker was $55,550 and talked the dealer down to $52,000. Here I am now. I don't know if this helped any but it was my experience.

Doesn't seem like BMW helped out all that much. You ended up paying $2500 ($37K - $31K - $3.5K) to drive a CPO lemon for several mos. Then, you got a regular deal many people are able to get ($3,550 off MSRP) to buy a new E90. This doesn't even include the amt of time and money you spent dealing with this hassle. Not sure what BMW did here to compensate you for your troubles.

Yeah It doesn't seem that it was that great of a deal but to me it was worth getting out of that car. It was a nightmare! I drove it to 40,000 miles before I traded it in. That may be why? Depreciation maybe? Also I know when you drive a car off the lot it loses some value so I accounted that in also.

Oh and I did talk to two lemon law lawyers and they told me that it didn't meet the PA lemon law rule. It had to of had 3 repairs on the same thing within like 90 days or something like that.

Thank you everyone for your help! Looks like Monday myself and lemon lawyer will be planning our attack. I knew I could get the down payment I put on it back but never knew about extra cash.
