I have a 10/06 build e92 335i, thus I have no extra oil cooler. I called BMWNA about two weeks ago and someone got back to me today and the guy told me that they "left it out for a reason". I then said, then why are they on there now? No good answer there..."BMW has the right blah blah blah" I then asked if it could be retrofitted on my car and he said the only reason why anyone would want to have it added was if he/she was going to be racing the car, thus voiding the warranty. He then said that all these people getting retrofit oil coolers will be "suspect"

What the hell is up with that? So I guess in 10 years, if your planning to drive past the speed limit, that will void your warranty. Oh I forgot...He said that people who are suspect, if they ever come in with engine issues, they will send the ECU to New Jersey, where they can read it and determine certain things like speed's, rev's etc.

I have a Nov build 335i step sports without the cooler. I have not communicated with BMW yet for the retrofit. First, I am going to check my VIN to see if it indicates my car is supposed to have the oil cooler. Some VINs do so and the car did not have one, but the person contacted BMW and is getting the cooler. I am also a lawyer and am seriously considering a class action on this issue, especially if my VIN suggests my car should have the oil cooler. So, please keep everyone posted on events involving communications with BMW and if you receive a retrofit. Tx.

I have a 10/06 build with steptronic and no oil cooler. I am going to bring it to the dealer once the oil reaches 300F and won't take it back unless they install/retrofit an oil cooler.

That's crap. I talked for a long time with a reasonably high up field engineer here in Canada and he's got a head on his shoulders. The kind of guys you're dealing with at a dealership or CS level are not indicative of most BMW tech employees, thankfully.

im not sure exactly the law, but we had a customer blow up his M3 obviously beating the hell out of it. we looked in the DME and found that at the time of failure he was at Wide open throttle, in 2nd gear at 90 something mph and 18000rpms. I know some of you are going "hey i didnt know M3s rev'ed that high!!" they dont. he was powershifting the car (most likely in a dragrace) and with his gas planted on the floor, missed a shift to fourth and put it in 2nd instead.

well, we went about it in the wrong way and used the data as the reason why bmw was voiding his warrenty, and his laywer found a loop hole in NJ law as to why that was an invasion of personal privacy. (I agree, you pay $60k for a car, it your to do what you want) and we had to cover it.

HOWEVERRRRRRRR, since then we have wised up, had we said "hey you bent every valve in this head, its very obvious you over-reved it" it would have been perfectly justifyable(sp?) because now you are basing it on evidence. so thats what most dealers will do. they will see the info, and not use it against you, just use another reason why they should void your warrenty.

this happens all the time BTW. EVERY car company tries as hard as they can to get out of it. look at Subaru. they were giving away free memberships to WRX buyers to join scca racing clubs......then they would check SCCA's records for their cars, and void the warrenty on those customers who were club racing. fucked up huh?

Yes thread digressed....

I have to agree someone have to show me the federal law that says Black Box information can not be used against you. I am not sure of the NJ case of M3 racing is valid plus all the information is not avaliable.

With that said, there is also cases where black box information was used against people for insurance claims. Where there was an accident and the person claimed they were not doing anything wrong and the black box showed otherwise and their claims were denied.

The company I work for just sold off a division who was making these type of black boxes for the auto industry and I have personall talked to the Hard Drive companies who's drives are being used and these boxes and they are storing information about your driving habits. The question you have to asks is why store it if they can not use it against you.

I predict interesting court battles over this one, and they will go something like this: "Hey I broke the law, I was speeding and driving wrecklessly, had a accident and my black box ratted me out and that is not fair. I should be free to break laws and hurts others without having my car rat me out. It not fair that the authorities do not have to work so hard to prove I screwed up" The problem is most people do not know their cars have these.

Back on the subject, I think the SA or whoever called is BSing you and trying to keep from putting the cooler in by scaring you with pulling the "void the warranty" card on you. I have 6MT with Sport package and I got the cooler so does that mean my warranty is now void since I am assume to be racing.

Yeah, when I heard Subaru was doing this it pissed me off and I don't even own a Subaru. There is something wrong about an invasion of privacy and doubly so, when it's also entrapment.

Got a call from BMWNA today asking me questions with regards to my email. I told them I bought the car in March and it should have a oil cooler on it. He told me that he'll make some calls and get back to me on my case. Apparently, they will send me to my dealer for a kit install. Will keep it posted with any news. Don't really bother right now for this kit although if they offer i'll get it. My car does not seem to have any overheating issues so far.

IMO 98/100 USA cars will not have any benefit from adding the oil cooler. This is a risky prediction: we will see what happens with cars in the southwest (AZ etc.) this summer. If they do not overheat during reasonable stress -- say 120 mph on a 110 degree day with AC on -- then I don't see that there is any real problem. I have yet to see my oil temp rise above 240. It's always right there after warm up, under any conditions. Then again, I have the oil cooler
