can a dealer sell a car you signed for already??

I recently "purchased" a car from a dealer and I won't say the name until I fully know the truth. So I went in Sunday evening to buy and sign for 335i I have wanting. Test drove it dealer a bit and finally agreed to price for which I signed for. Since it was late near 6 they wouldn't be able to detail the car and fuel it up for me. So we decided I would come back wed(tomorrow) and pick Her up nice and cleaned up with a full tank of premium.
The reason why it was left for wed is because I work 2 days straight and finish wed early am. Any who, I received an email about 3:30 or so and they informed me the car had been vandalized. They broke the driver side windows and stole the drivers seat and nothing else was done. I asked them to send me pics which I still have not received. They also said it would be difficult to find a replacement seat because of how difficult the color is to find. coral red I believe is the correct name.
I told them I will be going tomorrow to look at the car and said the car is at there own shop closeby. Has this ever happened to someone and how should I approach this? Again to me it sounds very fishy and calling BS on the whole matter.

Sounds really fishy. If they are telling the truth, since you have not taken delivery of it, the dealership's insurance should pay for everything including a brand new seat ordered from Germany if need be.

It sounds like, if they don't send picture of said damage, they are trying to make you pass on the car since it was damaged so they can sell it at a higher price to some one else.

Either way go in expecting them to try to screw you in someway but be calm about it so you can think everything through before agreeing to anything.

this sounds so bogus... they must have sold it to you for so cheap they went and tried to make some BS up to sell it for more...

That's what I'm thinking. Tomorrow I will be there and going to ask to see the car, police report, and ask for answers. I've jump through so many hoops and all the extra info plus 100 emails so far. Guess this is what I get from your typical small dealer. Just thought this one was different from the reviews I read. Again not going to mention the business as I could be over assuming but it def sounds like BS.

i'm thinking... you should send in someone else.. like a friend who can be "shopping" for a grey car, any grey car, and preferably a two door.. and then if this "search" lands on your 335i bam.

idk what you can do, maybe file a sue claim or just bash the hell out of that place and tell ppl how shady that place is.. but yeah..

if your gut feeling tells you they stiffed you.. then i think thats just the way it is.. is it still considered theirs even if you signed for it? technically you haven't made a payment.. correct?

but yeah.. if a friend of yours goes in and sees that it is not there.. then maybe they are telling you the truth.. but them not sending any photos or telling you that a police report was made and that everything will be fixed.. then... you know whats up.

Just found out they ran my credit 9 times by .y identity updater. Emailed them twice this morning and still nothing. I will be calling in the next hour to find out WTF is going on

Ok... Just got off the phone with then and Well it actually seems like the vehicle really did get broken into from the person I spoke to. They are contacting there shop manager to send me photos along with the driver seat that was stolen and the turn around time to have it replaced.
Sick of waiting I'm off to mountain view Bmw tonight to look at my options

Some coincidence huh? A car you signed for suddenly gets vandalized? Were the other cars in the lot met with the same fate? Probably not because this so called "vandal" just wanted to steal a Coral Red sports seat. Don't know man but I'm raising the bullshit flag on this hot little mess.

I'm still calling bullshit until I see some physi evidence and or a police report. Not sure about any other car as I haven't had that answereds quite yet. I finally have a day off tomorrow so should find out indefinitely what exactly happened.
Car buying was suppose to be fun as this is my first BMW. I just hope all my questions will be answered tomorrow. They don't even know I'm coming so we'll see.

Well here is my decision. I found a similar car at my near by BMW and its actually a better buy. CPO 2011 335ix, grey, coral red interior, 6spd, and m sport minus the navigation. But.. This comes with the x drive! X drive over Nav any day!! They are asking 2 grand over my initial buy but this is a way better buy.

Personally, I'd choose iDrive>xDrive any day. Not really a necessity for California weather

but i cant help but find it funny that you wanted the dealer to honor the sales contract instead of trying to sell it off for a better sale... and now you're considering to back out of the contract instead because you found a better buy. LOL

The reason why I'm backing out is because they are still telling me they don't know when the car will be prepared. What.. Am I suppose to wait for them to fix if this is what really happened and buy a vandalized car?? Pass pass and pass again. The dealers name and honor should never be used in the same sentence. They've spoiled my excitement of owning my first BMW. But hey shit happens for a reason I suppose.
