First off, as mentioned numerous times above, get a lawyer.
Secondly, if you hold title with your father as "joint tenancy", you will be the owner by way of survival for everything you hold this title to.

But I strongly advise you to get a lawyer, this chick will find something.

If anyone has any doubt how this could end up even when best lawyers are involved just look at Anna Nicole and her Billionaire hubby situation. When there is money involved all the legal contracts and pre-nup and stuff go right out the window since no judge or jury is going to deny a wife of those assets unless she is a total waste case or a criminal.

I am going to make a suggestion here, but I do not believe it is fool proof. The only way to ensure the new wife gets nothing is to transfer all assets to the son now, but he will have to pay all kind of taxes that is for sure since it not an inheritance, it would be considered a gift at that point. Even if this happen, her lawyers could probably argue that this was done to keep her from any of the assets she would otherwise gotten from the marriage.

BTW, you probably want this thread deleted since the new wife could find this later and use it to show the court your purpose was to defraud her in the first place.

I would look in the LLC idea for the income generating assets.

My father and I are sitting down with a lawyer next week. Going to get this taken care of. This is turning into a mess. My father is pretty old, as old as most peoples grandparents and I am in my mid twenties and this girl is younger than me, this is freaking insane.

My father recently screwed me out of 10k also, and refuses to give it back. This thought process is illogical and I think he is becoming senile and if they do get married I am going to see if I can declare a death bed marriage.

Not an attorney, but this is my understanding for this type of things from people I know and what they went through. So do not take this as an advice and use it for reference only.

If he has a living will, the court will assign his assets according to it. If he states that he wants you to receive 100% of his assets, then whatever is his (minus her half of whatever they own together) will be yours. That's not to say that she can't appeal to the court and ask for money from his estate. The outcome of that is usually determined by how the will is written and how long they have been together. If your Dad's Will specifically says not to give her anything, she will most likely get very little to none.

If he doesn't have a living will, you are pretty much screwed. She by default is entitled to most of his estate - minus anything he owes to the creditors.

The only safe bet here is that if your Dad and you own a property together now, your half will always be yours. The other half will be determined by the Will or the estate court if no living will was established.

Oh wait I get what you're saying.. Anna Nicole Smith deserved to be worth 450 million dollars because J. Howard Marshall just wanted to be happy. I hope you don't believe it's "ok" to let someone who isn't even blood into your family and allow them an equal share in the family's wealth based solely on how moist she is.

But maybe you're right, this girl probably worked that ass off to get OP's father to marry her. That hard work deserves some compensation, right? Or perhaps it is solely based on her undying love for a man who is "probably" twice her age (or close to it).

Doesn't matter, it's not up to us or OP to decide.

I see it this way, no matter what young gal's intentions are, if she makes old man happy, so be it.

However, it's really f$cked up when stuff like that happens all people think about is money.
