A legally binding contract cannot be formed or enforced that involves performing illegal activity, not to mention duress should be very easy to prove.

agree, and I think the case will be dismissed. The guy is currently in prison awaiting trial for murder.

I don't understand why stuff like this is even allowed this far, when someone files a suit, a judge should have to look it over before it's even forwarded to the people being sued. Why should they have to pay a lawyer to get this dismissed.

When are government passes a new law they just another welfare program for lawyers, only difference is instead of it being paid out of taxes (well part of it is paid out of taxs, the DA and judges salaries) the individual usually bares most of the cost to defend themselves. In this case, the guys lawyers which I assume is court appointed will be paid by tax payers to bring this case and the judge of course will make money even if he entertains this case for a sec and obvious the poor couple will have to pay lawyer to defend themselves. |

There are no court-appointed civil lawyers. This person is an idiot. He probably paid hundreds of dollars to file this lawsuit himself and he's surely going pro se since no lawyer would waste his time on this type of crap.
Edit..i read some of it. Actually it's just a counter-suit. There was already a pending lawsuit by the victims for his intruding into their home..counter-suit is not a new lawsuit. |

Hostages were smart. If I was in the situation I would do everything I could to make the criminal believe I was going to help him. Then when the cops arrest him id kick him in the face.
