BMW ineptitude car not taxed

Happened to glance at my cars tax disc today and realised that it expired 2 months ago. Now this would normally be my fault but the car is a contract hire vehicle direct with BMW and they are the registered keepers and hold the vehicle registration document V5C. Checked online on DVLA website and the car shows up as unlicensed.

I will get on the phone to BMW but if I get pulled up for not displaying a tax disc who gets in trouble, me as the driver or BMW as the registered keeper? Should I put the car in the garage or keep driving it, depends who is liable I suppose. Anyone experienced anything like this?

The driver of any car has the responsibility to ensure it is legally on the road before driving. I.e. MoT tax etc, having said that if you get fined I would be passing it on to bmw. They should of ensured that you are legal as the paper work goes to them from from dvla.

I drove round for weeks over Xmas 2010 waiting for my tax disc to arrive, when it didn't I contacted the dvla then the dealer, who told it would be it in the folder with all the other documents! The day I bought the car, BMW had happily waived me off knowing that it wasn't on the car. I've never bought a car before that didn't have the tax disc fitted already

So that will be the company hiring it.

But the trouble is the Police may seize the vehicle in extreme circumstances and this won't help the driver

See what they say.
If they drag their heels I would suggest hiring a car and back charging them for failing you under contract.

No, it is a legal requirement to display the disc on the car you are driving so it's the driver responsibility in this case.

The fact the tax disc hasn't been paid for or applied for is the responsibility of the registered keeper.

The law covers it for both parties and if involved in an accident will probably void the insurance as the car is technically being used illegally.

Not true. The insurance company may have a legal right to refuse a claim because the car is untaxed but they probably won't.

Thanks guys. The first person I spoke to today said she would ring me back after sorting it out. Never rung back so a few hours later spoke to someone who explained that the v5c has to be sent from Birmingham to Leeds. Someone in Leeds then has to physically go to the post office and I would get the tax disc sometime next week. I told them that this was unacceptable and would they therefore agree in writing to pay any fine that might be incurred? Finally spoke to a team leader who has promised to send the tax disc tomorrow by Special delivery.

This is against the background of trying to get a copy of my v5C from BMW Finance for some time. I originally rang them some time ago for a copy of the V5C as I will be driving in France. They promised to get it to me but after a week nothing so I phoned them back and they promised to get it to me. Week later still nothing so I rang again and somebody promised to have it sent to me by email by the close of the day but again no V5C so I phoned them again. Somebody promised to ring me back after looking into it guess what nobody phoned me back.

Today I managed to get the same team leader who sorted out my tax disc to send me the V5C in minutes.

It seems that there are lots of people in BMW finance who couldn't care less and a few good ones who make the effort.

My tax disc was sent to me a few weeks before the old one expired, it is a BMW contract hire vehicle as well, so they can get it right! I have to do battle with them in a couple of months though, as i try and get my private plate off the car and onto retention.
