Tracking the system in his bmw? I wonder if they can do that legally here in the states. But other than that I really don't think this personal matter should be discussed on the forum.

In this case they did not put a tracking device they use the internal BMW assist system that comes in ever car. Yes they can legal use this to find someone as long as they have a court order. Police in the US have use the OnStar systems to local a person they were looking for.
