They operate this way because the vast majority of consumers don't fight it, either because they don't know better or don't have the time. This leads to cheaper settlements, which leads to greater profits. Simple as that. The "sue us" response is in this same vein. They know many people won't go to the hassle. Cheaper settlements, bigger profits.
My opinion - it's criminal that this industry is allowed to operate this way. When faced with this dilemma, lawyer up and go get 'em. Also consider small claims court if the difference in what they're offering vs. what the repair costs are is less than 5K. Easy to do, no lawyer needed, and much more fair for the consumer. Better yet, do research and switch to a reputable company. None of them are great, but there are many of them that are horrible.... -Rick
