slightly damaged cosmetic part on the underside of my car???

bought a CPO'd 2011 328i...looked under the car for the first time and noticed that a part (I am thinking it is just part of the mud flap or undercar shield) looks bent. should BMW replace this? it worries me why it was like this. see picture attached or link.
