Lost in post - when to refund?
Willing to be wrong here so no naming and shaming. And I'll try word this 3rd person so as not to influence opinions.
Item bought for stated price inc delivery private sale and sent royal mail by seller. Sellers choice Nearly 3 weeks since payment and not delivered. Royal mail 2nd class states 2-3 business days to deliver and claim cannot be made until 15 days So claim to be made and tracking shows its still in progress since posting on the 29th January. When to refund money to seller? A - After the claim has been settled B - Now as item is past the expected delivery day |

His dispute is with the PO not you, I don't see why you should be out of pocket at any stage. Good luck mate.

The buyer has not got the dispute with Royal Mail - it's the seller!
As RM compensates the sender... NOT the receiver! So the seller needs to give a refund & claim from RM! So..... I would start the claim process & let the buyer know this! Once RM have confirmed it's missing, then issue a refund. |

I sell a fair bit on ebay and get this all the time, its a pain in the neck tbh, now my items if sent by royal mail are always tracked at the buyers cost.
If the buyer is willing to wait for you to get your refund from RM thats great but most are not as it can take up to 4 weeks to get your money back. I have now started using hermes courier service, near on the same price if not cheaper than royal mail, and you sign for it at your door, once its been signed for its then down to hermes and so far so good

Its looking like I maybe worded this making it look like I am the seller.
I'm the Buyer and so far glad to see it seems most agree with me. Not going to fall out with the seller as I'm sure he's not being funny and its just his opinion that this is the way to handle it and the refund will come but if it was me I would have refunded by now and dealt with the claim myself. |

Agree with the above. The seller has the contract and dispute with Royal Mail.
No claim can be made until after 15 days, so maybe a few more days for RM to confirm the item is lost and a claim in process. Once confirmed lost, a refund should be given. |

I agree with the above. The seller has the contract. It's why guaranteed delivery times are worthless. However I would be a little concerned that the seller wants to wait for the claim to be settled before paying you. This implies to me that if for any reason the post office won't pay or pay a reduced amount he expects you to be the one out of pocket.

The seller needs to wait for RM to confirm that it is lost in the post before refunding, if the seller refunds before this and it does end up being delivered the seller then has to try and get payment back off the buyer!
Buyer needs to be patient and at least wait for RM to confirm that it is lost. |

A few opinions now and I think the fairest is to confirm its lost and then refund which should be confirmed by him enquiring and hopefully not drag out having to claim and settle before they admit loosing it
Sure it'll all work out fine. No harm done and we'll see how he gets on. Just shows we dont all agree but doesnt mean anyone is wrong either |

Yep, as above. Onus is on the seller to sort this. In the meantime, they need to refund you as soon as the item has been confirmed as missing - which should be simple if it still says in progress.

In my experience, it takes a good while to get money out of Royal Mail, and as has been said, it is up to the sender to raise the claim.
I sent some BMW bits a while ago, and they never arrived, so I made the claim - it must have been about 2 months later that I got a refund of postage plus value of the bits (I had to go to BMW to get an invoice for the parts, even though they were 2nd hand, then I made an estimate of value). 2 days later, the parts arrived ar their destination!
