They shouldn't need too much adjusting to get right. In the past my biggest issue was making sure they went in far enough. There is a black rubber seal on the lights, how does that lineup on the inside when the boot is open?

The light should fit 1st time, its 3 holes in a panel and they should be generally a correct fitment within limits (mm), If they are that difficult to fit then I would be inclined to believe something has happened in that area, as in my earlier reply strip out and take some measurements from the n/s on the inner wing panel inside the boot using identical reference points and compare with the o/s this will give you an idea if there is one where the problem lies.

My logic was that if it has had some work done to it and the people who repaired it didn't know the lights were different between e92/e93. People do list them on ebay thinking they are the same.

I thought this first but when i took the lighs off. looked at sticker on them and they had E93 on them. notsure what else to do

Have you removed the all trim covers on the inside to get a good look at the panels, tbh from what you have been saying that both lights are not fitting correctly would point towards accident damage, did you have an hpi check done before you brought the car?
