The only way you'll know whether this is correct or not is to speak to the TPI directly. But Kindertons wouldn't usually tell you this for no reason.

As an update for those interested; collected my repaired BMW on Thursday. Which is 8 weeks after the accident.

As I understand it, liability is still being disputed.

If nothing else, the process has left me with even more disdain for 'tailgaters' than before.

A good rule of thumb and something to remember for future 'incidents'. A 3rd party will almost always convince themselves (within 24hrs or so) that they weren't to blame and that it was *your* fault. Be prepared for this inevitability and you should be fine.

Would a rear dashcam have helped here?

I've only got a front faced one as i thought anyone coming from the rear would be at fault? Perhaps i should get a rear facing one too.

I had an accident in a car park, my fault as I turned in too late and clipped a cars bumper. Not much damage, probably new bumper for him and I had to have a respray. That was in Jan 2014 and I rang my insurance straight away to tell them of the incident. Fast forward to now and I believe they still haven't sorted it but I've changed insurance companies now and whenever I try and get a quote, some won't quote as I can't confirm if it's been settled or not. As far as I'm concerned I done my bit and left it to them.
I was in the wrong but from what I understand the other party haven't claimed or hadn't a few months after the incident.
Really don't see why it takes so long for insurance companies to sort it out.
If he hit you from behind then it's plain and simple who's at fault.
It may be now that because of all this crash for cash scams they are reluctant to pay out until they are 100 % it's not a fraudulent claim.
Insurance..... Don't you just love it lol

Similar situation here... had an M3 rear-end me Feb last year in my 320D 1 month after ownership! (See previous threads) Few thousand of damage in one corner, 7 weeks being repaired, and still the other insurers are quibbling this and that... sending more witness statements off today! But to be fair I've not paid anything and have renewed my insurance since then without affecting my no claims.

It is in your interest to ring your previous insurance and find out if that claim was settled and if yes what was the cost.
Sometime insurance works out cheap if you put the correct amount than leaving it blank or no decision made yet.
