please help. warranty voided
Hi people I'm new to this site, and just wanted to get some advice from anyone that's willing to help.
I own a 2007 e92 335i got it 5 months ago at a dealership has 63 thousand miles. Has powetrain warranty trough this warranty called Q certified warranty. I took it to bmw dealership they said I needed a new transmission. an inspector from q certified warranty came looked at the car and voided my warranty, due to installing HR sport springs on my car and my car had scrapes on the bottom of the bumper, but those scrapes I got them before lowering the car. my girlfriend drives my car and when she tries to park she goes over the block that's before the sidewalk in parking space. what can I do? Am I screwed? thank you guys for your help.. |

Damn I might have straight up swung on this fool if he tried to hustle me like that. The under-body of the car has a bunch of plastics covers to shield components such as the transmission. So how the fuck did the tranny get damaged? The only thing that could have happened is the plastic cover getting scraped up. Right of the bat what ever warranty you have is shitty. It's obvious they spend their money into finding was to NOT repair the vehicles they have insured. As him what exactly was damaged and demand he shows you the damage.
Now what do a few scrapes under the bumper have to do with the tranny? Most people have scrapes under the bumper, even those without lowered cars.. A lowered car would not cause the tranny to get damaged... Demand he gets his ass back out there. |

I take it the plastic shield that covers the actual tranny has no scrapes. Lift the car and take pics of the under body. Demand to know how the tranny could have been damage since the underbody does not show any signs damage? It is damn near impossible to damage the tranny unless your car is literately scraping on the ground. This guy is an idiot.. Ask for them to send out someone who is competent.

Your third party warranty denied the claim. Even if you go to another dealer they already said no.
This is going to be a hard one make sure the dealer says its not your fault its internal etc. |

New transmission sounds dubious. I'd get a second opinion. Is it 6MT or auto?
All else fails, a used transmission can be had for fairly cheap if ebay is to be believed. |

Screw that dirtbag warranty company. Get them back out there. I guess the adjuster gets paid to deny claims...pretty sad. Post their info. Also call your states AG and report them.

You could see if the dealerships will back you up in some way … maybe see if they will call on your behalf or write a letter on your behalf stating that a lowered suspension has diddly to do with a bad transmission.
Did the car come with the warranty or did you purchase it? If it came with the car, then raise hell at the dealership you bought it from.

Same happened to me 4/5 months into the car. BMW na did nothing and the dealership tried to charge me 9 grand for a rebuilt one. Your best bet is doing what I did car-part.com or eBay find a good grade a transmission with the warranty and slap it on replace all fluids and mechatronics sleeve and new pan and your good to go.

Unfortunately, it is time to lawyer up. Get, in writing, why they are voiding the warranty. Also get a repair report from one or both the dealers who looked at it. Those will all be important documents for your day in court.

Lawyer up. The 3rd party warranty company has to prove that those modifications caused the transmission failure. And there is no way that happened. Get the denial in writing, get the dealership's opinion that the transmission is bad, get your original warranty paperwork and seek a lawyer asap.
No other BMW dealership will help you, BMWNA will not help you. Its now you vs 3rd party warranty company. Its not uncommon for a 3rd party warranty company to deny a covered part due to "modifications" so they dont have to pay. What did you pay for the warranty? Say $2,500? Whats a new transmission plus labor going to cost. You do the math, they lose here.
