Dealer Dishonesty and Damage at Delivery Question

I contracted to purchase a 335xi and was told i may be delayed as it was on the ship BEHIND the Courage. I had delivery scheduled for Tuesday and insurance cards sent to me. On Monday I received a call from the dealer who said it would not be delivered Tuesday but probably Saturday. At that time I asked 'are you sure it was on the boat behind the Courage?' and was told 'yes'. I changed the insurance effective date to Saturday.

Friday I received a call from the dealer telling me to change the effective date on the insurance as it would not be delivered Saturday and they couldn't promise exactly when it would be delivered. Again I asked 'are you sure it was on the boat behind the Courage?' and again I was told 'yes'.

Something didn't smell right so I went to the WWL shipping site and entered the VIN and found out the car WAS on the Courage. I called the dealer and was furious. They said their system doesn't tell exactly which ship the car is on but they would call the port again and find out the status. They called back and told me the car had a one inch scratch on the bumper and according to BMW policy the whole bumper had to be replaced.

I explained that, having been lied to in the first instance, I was not sure how to believe them about the extent of the damage. They reiterated that it was a one inch scratch.

So, here is the question. It is hard to find the exactly equipped car anywhere near me in another dealer's inventory. One other dealer has it minus the iPod integration (which I really did want). The first dealer asked me to give them to monday to see if they could get me a delivery date. So, should I believe them about the extent of the damage? Is there any documentation? Is there a way to verify what the dealer is telling me? Would you accept this vehicle? What to do, what to do , what to do?

Have them get documentation directly from BMW as to the extent of the damage.

The damage will be fixed at the VPC, unless the scratch occurred while it was en route to the dealer. Then, they will have to fix it...

Also, try contacting the BMW North America customer service line... Maybe they can help track this vehicle for you and obtain some documentation for a would-be new BMW customer.

They sorta "lied' to you twice about the car being on the Courage sooo why not lie to you about the extent of the damage as well ...an inch , two inches , a foot it doesnt matter ?? Not for nothing id start all over with another dealer if needed. How can i customer tell where his car is and the employees of bmw cant with their system hhmmmmm ?? Id say they lost a lot of their integrity with their mistakes.

They are lying, get the documentation from them in regards to the damage or get the car somewhere else.

Nice..they have a hard time tracking down which ship your car is on and they can track down the position and size of the scratch so easily...nice....

Out of all the pictures that have been posted up with the damaged cars on the courage. Do you really believe that yours is a lucky one that only ended up with a 1" scratch on the bumper??? If they cant give you a straight answer from the get go, I'd get goin somewhere else....

Call the 800 # an they will then get someone from VPC to contact you. When I had my ED car delivered there was damaged to the left front wheel and tire. It had to be replaced however BMW told me exactly that. So give them a call and make sure you get to the bottom of this.

Can you please tell us what dealer this is?

Go to a different one. Replaced bumper or not. When im purchusing a new car i want a brand new car and not a repaired one.

The issue has been taken out of the salesperson's hand and I am now dealing with the sales manager. He s the one who promised to call me tomorrow.

My willingness to state the dealership's name depends on what he tells me tomorrow, what he does to address the issues of the lies, delays and the veracity of the information about damage. I would expect they would give me some concession to make up for the issues.

I will advise the group tomorrow but would appreciate further thoughs on to take it or not if it really is just a scratch and a now replaced bumper.

IMO if its a stratch on the bumper, door, or any other cosmetic body panel or evern if its a ding who cares. They will replace those parts just like they replaced my wheel and tire. Things happen when vehicles gets shipped. Its not like its a bend frame, faulty wiring, wheel alignment thats off, engine problems or a leaky roof. Its cosmetic...things that can be fixed or replaced with damage to the integrity to the ride. All these people giving you advice on voiding the purchase or making them get you a new car are plain ridiculous. They are just post whores who feel the need to voice their negative opinions. If push came to shove and they were waiting for their cars to come after a 3 month wait I dont think a scratched bumper that is going to be replaced would hinder from taking delivery of their new car.

I agree with your statement, however the problem that the OP is facing (and I console with him) is that after bieng lied to on 2 different occasions, he will never know the full extent of the car's damage. The dealer said it was on a different ship twice and that the car had not arrived, now the story changed to the car bieng on the actual ship and is at the VPC for a 1" scratch.

What I would do in this instance, is contact BMW NA and ask for the real answer from the telephone operator (they will 99% tell you the truth, they really have nothing to win by lying). If in fact there was damage to the car in the form of a scratch; I would definetley speak to the dealer or somebody superior at BMW NA and ask for a refund for your inconvienience and any accrued interest or payments for the delay in premium for your insurance company.

If however, the damage was related to a structural component of the car (frame, engine, etc.) I would definentley reorder the car through a different dealer and ask that the deposit be transfered over accordingly.

The sales manager called the port and confirmed the damage was isolated to the bumper and assured me it would be prepped for Thursday... I then called BMW NA exec offices who will separately find out where the damage was and will decide from there.

Any thoughts?

I personally wouldn't worry about it. Especially if it is just a bumper skin being replaced. They will address it, this is what they do at VPC.

what i would have said was "you told me it wasnt on the courage but it was and now your telling me its damaged as well but how am I to believe anything you say?" see what they will do for you to keep you as a loyal customer and to give them all 5s when the customer survey comes along....

I wouldn't worry too too much, I think many new cars get touched up at VPC (and they're supposed to be almost factory). Also, "any damage over 3% of the price of the vehicle would result it the vehicle NOT being sold as a new car. So, even on a $60k car, they are capped at $1800 worth repairs."
