Consumer Rights Act 2015 - If your new or used car has a significant fault that was present when you bought it (as opposed to developing afterwards), you can reject the car within the first 30 days and get a full refund.
You do not have to accept a repair or replacement vehicle (although you can if you want to). Surely i can give the car back now if they dont let birmingham bmw fix the car? |

If that's what your research suggests, I know a lot of consumer rights/buyer protection etc changed recently so make sure it's up to date. I was under the impression you couldn't just reject straight away, but I've never had to look in to it.

I rejected a car from BMW (as mentioned in last post) under the consumers rights act 2 weeks ago.
You could say you accept the offer provided the problem is fixed when you get it back, otherwise it will be rejected. |

Yes you are perfectly within your rights to reject the car as the fault was present at time of purchase and wasn't disclosed/known.
You do not have to accept the repair as it's your right. You can't specify that they cover BMW Birmingham to sort it as it's down to the original selling dealership/garage to resolve. If you genuinely really like the car then quite simply state you will give them this one opportunity to resolve the issue and if they can't then a full refund is required on collection of their courtesy car.

Thanks for all the help guys, im going to push for them to cover the cost of bmw birmingham fixing it otherwise im rejecting it. I do like it but not enough to keep it with a dodgy water leak. Im guessing they will not want the car back now as its going to have an extra owner and there going to have to sort this problem out anyway.

UPDATE - Dealer agree to let birmingham bmw look at the car, Been quoted £3000 to fix the seals....... And the orginal dealer has refused to authorize the repair.
Now what? Its been 3 months since ive had the car as the orginal dealer tried to fix it once then took weeks to authorize birmingham bmw to inspect the car. Called BMW UK and was told we cant do anything they are just a franchise, seriously whats the point of having a complaints number then? |

maybe you can escalate to the CEO/boss's of the dealers? i did that with an issue with rac recently (appreciate it's not the same but escalating to the bosses usually does get something happening)
