Arrow Help On Fighting Speeding Ticket

you guys know any lawyers, services, etc to fight a speeding ticket? i don't need an amazing one just one that knows what to do and has good price on his service.

4/23/07:
me and my friend ate mcdonalds and decided to crash at his place. so it's 1.30am and im following him to his house (jeep wrangler). while driving to his house, a cop came out of the night and pulled my friend over and i tried to continue (make a turn or something), but the officer quickly got out of his car and pointed me to pull over as well.

so when asked what we did wrong he replied speeding, going 65 in a 35mph. so me and my friend both got the same ticket and at the bottom it also noted that we were "racing" which is nonsense as i was following my friend to his house and he had a jeep and me a bmw (doesn't really matter but just saying).

were me and my friend really going that fast? no way. i had my valentine one and no signal went off and yet the ticket says the speed was measured by PACE (which i believe is the radar they use). my friend had a cobra radar and his didn't go off either. now i was not racing first off and was no way going 65. at the highest me and friend are going 45-50 but 65 is no way. i pleaded not guilty.

my friend (best friend from elementary school) is now living in thailand so he just paid off the ticket and went away as he didn't have to care anymore. me on the other hand is a different story.

??/??/07:
after pleading not guilty i got my 1st court date on ??/??/07 (don't have exact date with me). i missed the court date and 3 days later i got a letter in the mail saying my license will be temporarly suspended until the problem is resolved. so i drive to the court house and i paid a $200 bail to keep my license valid and for another court date.

4/12/08:
today i got a letter from court saying i have court date on 5/13/08 9.30am. so im wondering if anyone here has experience, connection, etc to a speeding ticket guy that can help at good price. im not looking for the best just someone that knows what he's doing. thanks guys.

pace means that be did not use a radar, rather he was following you to see how fast you were going.... this opens many debates on the officers judgment

i've used martin kron in the past-- i havent used him in years, but when i did, he got an 11 point stop knocked down to 3 points and a $500 fine. insurance rates didnt budge. his fees were 200 per ticket, so it cost me 1100 total including the fine. which is far less than what the insurance bump would have been

you do need the best, if he wrote racing, that falls under reckless driving.
that combined with 30 over is an 11 point violation ( 6 points for the speed, 5 points for the reckless)
if you're convicted, 11 points means a suspended license, and probably obscene insurance hike. do you have any other points on your license.

pacing means that he did not use radar or laser, he calculated your speed by following you.

need an attorney for this and the best would be the fine and no points, but either way its going to cost you some money...Cops are just pricks!

I use him a few years ago. I got caught on the outside lanes of Williamsburg bridge. He clock me at 61 for crossing the bridge. I paid 200 for his services. No fine or points. Good luck...

The only other thing you can hope for, is that the cop doesn't show up to court. Since this was from last year, there is a chance that the cop will not show up in court and your charges will be dropped.

But if he does show up for court, and you don't have a lawyer, your typically screwed. No pun intended.

doesnt work in NYC (jurisdictions covered by the TVB). they wont dismiss the ticket for a 1st time no show by the cop. i think the cop has 2-3 chances to show up before they dismiss.

Was the ticket given in nj or ny? I have no idea how ny handles tickets. If it's in nj, it depends on the town. Some really stick it to ya when they see that word "racing"

this is my 1st ticket i got in NY state (where i live). i have recieved like 2 others in the past in NJ but those i just paid off as points don't carry over.

if the pace is followed that is total bs then. the cop pulled out of a parking lot of a bank and turned on the sirens...

You'll just have to take it to trial. At least it's the words of you and your friend against his. Good luck! I'm going through something similar myself for over 4 months now.

HOLY SHIT GUYS!!!! i just got the ticket and at the back it reads:

6. Defendant's Speed: 65 MPH in a 35 MPH Zone
7. Charge based on Officer's Direct Observation
8. SPeed Verified By PACE

now when me and friend passed the officer he pulled out of a parking lot didn't even pace us but just put on his sirens and pulled over my friend. that means he couldn't have paced us at all he just came out and put on sirens.

so in this case i have advantage here right?

FYI , some Cops are certified to judge speed by EYE.... And it will stick in court. Your best bet is to find a good lawyer and they may be able to question the cops certifications in Visually Observed speed readings.

nope, your only hope is to get a lawyer that can impeach the officers testimony, or pick it apart with inconsistencies that matter in the eyes of the judge.
In NYC, you go to an administrative law judge, not a true judge. he's actually a lawyer that works for the TVB (traffic violations bureau). the officer's testimony will carry far more weight that you claiming there's no way he could have judged your speed.

trust me, you telling the ALJ that there's no way the officer could have paced you will land you a conviction. its your word vs the officer's and he will have far more credibility than you.

what kind of cop pulled you over? local PD or highway patrol?

get a traffic lawyer. TVB is pretty bad, there's almost no plea bargaining, its pretty much guilty or not. and i guarantee you, unless you can find a lawyer that either knows the ALJ or can take apart the officer's testimony, you're going to be screwed. my lawyer got two of the tickets dismissed because he ripped apart the officers testimony. you will not be able to do the same on your own

ex: there was no way you could have paced me as you just pulled out of the parking lot
resp: i am trained and certified in visual estimation of speed, and had followed you for 1 block at 65mph with a steady distance between us. with the calibrated speedometer in my cruiser, calibrated in accordance with regulations on _/_/_ i was able to determine your speed.

you're a liar is not going to cut it with the judge. the cop is a law enforcement officer that the court recognizes as being sworn to uphold the law. you are a motorist trying to get out of a ticket. whose testimony will they put a greater weight on.

can you recall the weather, the lighting, etc? the cop has all of that written down in his notes. his testimony is going to be a well practiced regurgitation of the facts he knows, phrased in a way that he knows will get you convicted.

bam, you're done.
