Just got some info from my dealer...

Bmw is about to introduce the next shocker for us tuners, even those of us who just lurk ;-) I hope you are sitting down, because, if successful, our days of tuning with any hope of warranty are over. They may even void cup-holder warrantees due to excessive vibration under supra-normal boost.

The next version of the tuner software, 29.3, will introduce even more aggressive anti-tune measures that, if successful, cannot be avoided with either a flash or piggyback.

The new version of the tuner uses data assembled from external sources, including bmw assist and active cruise control.

Essentially, this logic attempts to detect a tune before it is installed. Using a combination of sensors and a form of artificial intelligence, it can detect the owner's intention to install a tune. If the hood is open for long periods, it is assumed the owner is potentially planning or contemplating modifications. If the car fails to approach other cars, based on forward looking active cruise information, a high percentage of time, under WOT, a flag is set. Consumer is seeking a tune.... If the BMW assist picks up sounds of driver humiliation under WOT, similarly a flag is set.

Upon detecting this flag at the dealer (or via a BMW assist uplink, on 2009, MSD82 models), and if the consumer fails to purchase a BMW performance product with 45 days, the warranty is added to a list for detailed review.

In other words, I think the speculation and pontification is quite interesting, but often seems a little far fetched. Product changes and upgrades happy all the time. It's not necessarily the few percent of us on the boards that BMW is thinking of. Though I do think they are out to get us and ruin 7-15% of our driving enjoyment
