Oh haha... yeah I figured, but at the same time I was kind of hopeful for a certain answer Well, I plan on calling my Dinan/BMW dealership tomorrow and asking them if they are expecting the upgrade... usually the Dinan guy there is pretty knowledgeable. Will update if I get any good news...

My bulbs weren't the problem. Whatever they did, they fixed it perfectly the 1st time. I think it may have been a faulty sensor as my light was never "out". but my flash was never effected at all. When I took my car in for service, I was told they have seen numerous "tail lamp malfunctions".

I have the tail light malfunction light as well with Dinan stage 2. Best I can tell is that it is because Dinan uses an older version of software with the tail light malfunction bug in it. The dealer replaces bulbs every time I am there, but the tail lights have always worked fine. Small price to pay for performance.
Thanks for the replies, i think this kinda makes sense i just wanted be sure the flash was safe. whatever they do its ok, as long as they dont overwrite the flash. the alarm i'm a bit more concerned about.

I was suppose to have my 335i sedan flashed this week then we found out my build date was 03/08 so I needed it to be shipped off. Well after time spent talking to the dealership and then speaking with Dinan directly, the Aug. 10th date they informed me is an internet myth and they never officially set a date, they did say they were very close to the release but would not elaborate. They told me they might know something the middle of next week. Just FYI
