Okay, I went through the pics 5 times... and... well, the oem makes it 'smoother' as you said, but not necessarily 'better'
the m3 ones are more aggressive

So, the question is: do you want a smoother look or a more aggressive look?

OEM M3
OEM M-Tech

I have the M aero package. The skirts are maybe a 1/2" lower around, but retain the exact same style as the 335i OEM skirts.
I can't seem to find any info about the OEM M Aero side skirts. According to Tischer, the aero package only comes with these:

Body nut (x2) 07146951655
Bolt (x2) 07147129160
Front Trim 51110414371
Rear bumper 51120415359
Rear bumper insert 51120414375
Toe hook cover 51120415360

I find M3 skirts look much nicer on E92 since it has more of the sporty look. Adding M3 skirts with M-Aero, M-Tech or other type of aggressive front compliments E92 and gives it aggressive posture that works and eye pleasing.

With E93 boxy rear design, M3 skirts make the car look choppy vs clean settle lines flowing from front to back IMHO.

I've decided to switch back to OEM skirts, will do it next week and might try M-Tech OEM skirts next year...

Maybe they discontinued the side skirts then ....... the only real difference with the OEM & the M aero is the width. The rear M aero bumper sits a little bit lower than the OEM and the skits match up to that.

Maybe the M-Tech took the place of the M aero?

OEM, if it was a coupe I would say M3. Its just with the convertibles they look very square with the roof, lots of lines, and the M3 Skirts create more lines to give it a sporty feel, but with a convertible I think this is too much.

I do agree with you.
