Still need help with lease - my car is at the dealership.....
I will try to be as specific as I can.
I returned my last BMW on 9/11/08, placed an order for a new one on 3/5/09 because I had 6 months to capture "owner loyalty". Because I had an order in the system, BMW refunded my last lease's disposition fee (I already got the check). Here's what I ordered: 2009 335i xDrive sedan manual transmission alpine white/saddle brown premium pkg M-sport pkg cold weather pkg comfort access navigation sat radio factory alarm 36 month 12K mi lease, taxes up front. I have been using this sales associate for many years and have always felt a high degree of trust. He told me on March 5 that the loyalty money factor was .00170 and that the monthly payment would be $690 if the March incentive of $1000 was not extended, but might be reduced to around $630 if the $1000 incentive was extended and in effect at the time the car was delivered. He led me to believe that the MF of .00170 was a lock so that $690 would be my max monthly payment. The car was at the dealership much sooner than I expected, but not until after the March deals expired. The April deals favor the coupe over the sedan, the $1000 lease incentive went away. There is a $1500 incentive for purchase (not good for lease) and a very vague $3000 marketing allowance. The sales associate says the $3k can only be used for a cash sale or for lease/finance outside of BMWFS. To make things worse, he says that BMWFS will NOT allow him to honor the .00170 MF, as it was a loyalty rate, and the new MF for my deal would be .00215. The agreement I signed and have a copy of does not show the cap cost. We settled at $1200 over Edmunds invoice (I know I could have done better, but I didn't want to bargain too much with the guy's commission). It only states that I will pay the first months payment of $690, bank fee of $725, and sales tax up front of $2205. I left a $500 deposit on a credit card. Your opinions and experience would be appreciated here. Should I go to another dealer and show then the agreement, asking if they will honor that rate? Go to another dealer and not disclose the prior offer? Wait for May 3rd when the May 09 deals are disclosed? Should I (and can I legally) walk away and ask for a refund of my $500 deposit, since they will not honor the agreed upon $690 monthly payment? You can legally walk away and get your deposit back. Unless you signed something that said your deposit was non refundable. I know when I put the deposit on mine it stated in the deposit that it was refundable. I dont see an issue besides maybe some bad blood between you and the current dealer and maybe a little hassle when you try to go about it.

Your sales guy was misinformed...March loyalty rates were only good thru the end of the month. ie: you have to take delivery before 4/1
Unfortunately you have to either take the deal as it is now (.00215 MF and $1000 loyalty) or walk away. FS's rates are set, so no other dealership will do .00170 for you. If that was feasible, don't you think your current dealer where you ordered your car from would do it? |
