Can you lemon a CPO?

Hey guys i purchased my 07 e92 335 w/18k on jan 4th of 2010. The HPFP went out the day i purchased the car so they gave me a loaner and got my car back to me the next day. Now im at 18500 and having loss of power/long cranks. Now this would be the 4th HPFP replacement on the car

1st @ 7k (previous owner)
2nd @9k (previous owner)
3rd @ 18k (Day that i purchased the car)
4th @ 18500, hasnt been changed or diagnosed by BMW yet.

So what would you guys do if you were in my situation? I also have a concern about getting my fuel pump changed for a 4th time. I just read a few threads about the dealerships trying to cover up HPFP replacements with Injector swaps. Is there any way to document what specific HPFP i have so i can tell if they do indeed change the pump? thanks guys

PS; Im in Cali, could i at least try to get some money back?

WHAT IS A NEW MOTOR VEHICLE

The law discussed above applies to "new motor vehicles." (Certain limited protection may apply to used vehicles as described in Section 2.) The term "new motor vehicle" includes not only new motor vehicles but also demonstrators; the chassis, chassis cab, and propulsion system of a new motor home; and any other motor vehicle sold with a manufacturer's new car warranty. For example, a two-year old used car sold with the remaining one year portion of a manufacturer's three-year new car warranty would be treated as a new motor vehicle. The term "new motor vehicle," however, does not include motorcycles or exclusively off-road vehicles.

If you're still willing to keep the car, demand to replace the HPFP with the newest part #: 13517594943 and see how that works.

You can also ask for previous records so you can check what part was installed. The old HPFP ends in 2881 instead of 4943.
