Need advice on 2009 328xi... please help!

Hi everyone,
I am new to this board and sure new to BMW.
I was looking at 2010 328xi until the dealer try to sell me the 2009 328xi and I will need all your advice, and I know some of you on the board actually sell BMW, if you can give me advice, it will be great.

Here is the detail on the Auto 09 328xi (Silver w/ Black):
It's a dealer's loaner car (titled to the dealer) and has about 2000 miles or so.
The in service date is 8/15/09, suppose the warranty will end in 8/15/2013.

It has Cold weather package, premium package, Xenon, Hav, iPod/USB adapter.
CarFax report a clean title and no major damage/accident and the dealer said the car is clean, no damage or body work done.
The MSRP is around $46k and I can get it for $35350 (the best price).

To me this seem to be a very good deal but is it too good to be true? Think I can ask them to lower more?
I noramlly won't want to by a loaner car (I know how people drive on the loaner) but this only have 2000 miles, can it be that bad?
Silver? Isn't there are many silver car out there? Is that a bad color?
On the 2010, they can do $3k off MSRP, so the difference is about $6k 2010 vs used 2009 with the same options, what do you suggest?
I also asked about 2011, they are taking orders but no discount on those at this time, full MSRP, maybe 200/300 off, maybe.

i think they could do a little better, seems like some people on here are getting similar prices for 09's but there new
e90 or e92?

Where are you in Cali? Keep in mind the 2011 are actually lower than MSRP vs. the 2010 with options added as the many options are cheaper on the 011's. Plus 1 less year of depreciation. Honestly, they're charging you too much for the 2010 cars on the lot. You should be able to go under invoice for them now. About $4-5K off MSRP should be within reach for a brand new car especially on a 328xi(not a beat up loaner)

actually at the time I saw this i was looking a bit and long beach BMW in socal had an 09 demo 328xi with sticker of 45,500 for 29,995- it sold
