It has the latest firmware. Currently it is not jailbroken or unlocked. However, I can deliver it jailbroken for free.

For the unlock it would be $70 extra. There is only ONE guy I have ever heard of that does this and that's his rate.

I heard 3.1.3 isn't unlockable by any conventional method for the 3gs. Just wanted to put that out there in case anyone was planning on buying it and getting it unlocked. When OS 4 is released it can probably be unlocked.
