If it's under warranty then why arse about with it? I disconnected mine anyway and left it open on my e46.

It only closes as programmed for the specific vehicle to reduce noise at certain engine speeds, you can't see the flap when you're driving, so how do you know its not closing??? Are you hanging out of the boot to see it?

My 335i flap shuts on start up then opens, but it also shuts at cruising speeds to stop boom in the car.

The E90 330i I had, like yours, never shut the flap at idle hot or cold, so it must only need it when moving. On older E46 330i you could see the flap when following from behind and you could see it only shut as the car pulled away, only to open shortly after.

If you remove the electrical solenoid plug in the boot side panel, then the flap WILL stay open, you can drive it then to see if the sound is different at any points when driving, then you'll know it was working.
