Does the $610 include NJ sales tax, or is it before it? And, if so, what percent do you pay? Thx
Actually, just noticed that you posted that "taxes are paid." Do you pay them all up front? And, would that transfer to PA? Last edited by mr. zero; 02-11-2011 at 02:43 PM.. |

Well, either him, or BMW Financial would know. If it's 7% in NJ, I'd probably still have to cough up a little, as PA is actually 9% on leases.
Also, do you still have all the stock parts? |

hey zero. if PA works the same as every other state, when there is a transfer of ownership you have to pay tax again on the pay off price he sold it for you. Just because he paid the tax when he bought it doesn't always mean you're paid up. In IL I had to pay tax upfront on the 2 BMW's I've leased, then my last one I bought out to sell it to a friend, had to pay tax on my buying it out "claimed its a 2nd transaction" and then my friend who bought it had to pay sales tax on THAT transaction from me to him. The reason is because when you lease, BMW still technically "owns" the car. BOTH of you should check with your state offices as I think NJ will make you pay the tax again to buy it out then again in PA to register it to a new owner. A lease transfer would make more sense 1st if this is the case, that way tax is paid but transferred so when you pay it off its released to the NEW owner and not the old on (BMW won't release a title to anyone other than the original lessee on the account).

Thing is, he wouldn't be selling it to me. I would merely be assuming his lease, which he has paid taxes on, upfront, for the 36 month depreciation. NJ shouldn't get to keep all of that tax, since it will have technically only depreciated a handful of months in that state, and then it would be in PA. I don't think states can double-dip like that. BMW Financial should merely take his tax monies, and with my additional 2%, pay the depreciation tax in PA. Does that make sense, or did I do too much blotter in high school?

yeah if he is just transferring the lease to you, thats correct. Essentially no ownership is changing cuz BMW is still the owner. However if you buy it out at the end of the lease most states will view that as a transfer of ownership, just as if you were buying a used car from a dealership, so they'll charge you tax on that transaction.

Did you give BMW Financial a call? They would probably be more informative, no offense to your sales guy.

Talked to BMW Financial (pretty much worthless), and a BMW salesperson (helpful) yesterday. What we pretty much concluded was that you'll be getting a prorated refund on the taxes you paid upfront, and I would be socked with the full 9% on top of the basic $610 payment. Ouch.
