Class action lawsuit vs. BMW & Bridgestone (Bridgestone Turanza run-flat tires)
Yesterday, I noticed that my 2006 BMW 330i with 19k miles and Bridgestone run flat tires was handling weird. I stopped by America's Tire Co. and had them inspect my tires. They told me that both front tires were "cupped." As I have read many post about the low tread life of this tire and MAJOR disappointment amongst my peers, I came across a class action lawsuit that may interest some of you Here's the lawyers website: http://www.sfmslaw.com/pages/cases.php?id=573
BMW of North America, LLC and Bridgestone Firestone North American Tire, LLC Summary of Pending Case: On May 28, 2008, Shepherd, Finkelman, Miller & Shah, LLP, along with co-counsel, filed a Class Action Complaint on behalf of several Plaintiffs, against BMW of North America, LLC ("BMW") and Bridgestone Firestone North American Tire, LLC (“Bridgestone”) in the United States District Court for the District of New Jersey, Civil Action No. 2:08-CV-02619-KSH-PS. This action was assigned to the Honorable Katharine S. Hayden. The Complaint alleges violations of the Magnuson-Moss Act, breach of express and implied warranty, breach of the implied covenant of good faith and fair dealing, as well as claims under the New Jersey Consumer Fraud Act. Further, in the alternative, the Complaint alleges causes of action for violation of various consumer protection statues, including, California, Connecticut, Pennsylvania in connection with the design, manufacturing, marketing, distribution and sale of 2006 and 2007 BMW 3 series vehicles (“Vehicles”), equipped with Bridgestone’s Turanza run-flat tires. Specifically, the Complaint alleges that the Turanza run-flat tires on the Vehicles are defective and wear unevenly and prematurely, resulting in an extremely rough ride and excessive and disruptive noise from the tires. In addition, the Complaint alleges that the tires on the Vehicles must be replaced prematurely---in many cases after less than 10,000 miles, and very often after less than 20,000 miles.

Your signature indicates you have Sport, which means the Potenza's, yes? So you are complaining that you go 19,000 miles on tires that have a 140 treadwear rating? You do understand that 140 is really quite low, which means you aren't going to get 40-50-60 thousand miles out of them, right?
When I bought my 335i ZSP, I knew I was getting high performance summer tires that weren't probably going to last 20,000 miles. If I want high mileage tires, I'll go buy a crappy American sedan with some 80,000 mile guaranteed tires. Of course, it will drive like crap.

a) you have potenza's not turanzas. the turanzas are all season high treadwear tires. we're talking 300 vs 140 for the potenzas. the lawsuit is for the turanzas so dont get too excited.
b) if you expect sport package tires to last much past 18K....have you ever had a car with summer high performance tires before? c) class action lawsuits very seldom do anything but get the lawfirm rich.

Hey guys,
I realize this thread is pretty stale, but I just came across it -- up here in Toronto with the same problem with the Turanza's that came stock on my 2007 328i. Just replaced them with Continental runflats out of pocket. Running the complaint through the customer service channels now, hoping to use this class action as some leverage. Fingers crossed. /TT |

Has anyone got a class action lawsuit notice in the mail for this issue. It appears this has proceed and they are looking for participant in the action. I got my notice in the mail a few weeks ago and they got my name from BMW.

I got the notice too and depending on where and when you swapped your run flats you will get between 50% to 100% reimbursement for the tires you replaced them with.
So yes, the law firm gets some serious $$$ and so do the people who brought the suit but I am happy signing on to get $500 to $1000 or more dollars. |

I was not sure how this worked since I still have my tires and can not document how many miles I have on them since I only ran them 6 months out of the year and ran winter tires the other 6 months.

i got the letter/notice too. it went straight to the trash can. i already have a lawsuit in the works against the lady that totaled my E90. one is more than enough to handle at once

Has anyone got any money back on this, I am about to replace the tires and was wondering if this came of anything for people. I was thinking they were just collecting information and costs at this point so they know how much to ask Bridgestone for

The lawsuit settlement has been approved by the courts.BMW owners who replaced their tires will be entitled to refunds. You need to file a claim form which can be downloaded from the attorney's website; however, they do require a receipt, etc. showing what was done/paid.

Where's the money?
Has anybody actually received their refund yet? We filed last October and have yet to see a dime nor any response from BMW. My dad filed last July and has seen nothing either.
