Went to order a new vehicle with possibility of ED. Dealer had a single M3 on the lot and was encouraging it as purchase. Key dialogue point was whether there were any changes such as an LCI or feature changes if I waited for production date later on. Sales said NO. This ended up being factually very wrong taking into account there were two bulletins distributed to the dealer level announcing the 09/10 build date and later changes. I took delivery of the 04/10 build and found out a month later these changes are rolling out.
I don't care what anyone thinks, this was deceptive. I would have waited for one to be built.

You should have waited, regardless of what a salesperson could have told you... or did not want to tell you for whatever reason at that moment.

The problem here is that as early as March 2010 BMW was already installing the Combox in all 3-Series in Europe. Therefore, either you or the salesperson should have concluded/guessed that this option was coming to the USA sooner or later. That's a pretty accurate conclusion/guess, as this is what BMW does 99.9% of the time between Europe and USA factory options.

Because what you bought was a 04/10 production M3 then that means that your conversation with your dealer could not have happened before mid 05/10 in the absolute case, as it takes some 6-8 weeks for that car to get from Europe to that dealer. The official announcement of the introduction of the Combox was made by BMW around the 9th of July. So there was plenty of time for either of you to at least guess by the purchase date that the Combox was coming to the USA.

In other words, you have to prove that this salesperson did in fact read and understood that announcement before selling that car to you, and because of this lie, half-truth, deceptive sales practice or whatever really happened, you have prove as well that you lose something/damages were inflicted due to such practice.

And because it seems that you bought that car before July 9th then there's no way of taking the salesperson word as fact or even deception, as BMW do make changes even after making announcements -i.e. no iPod Out after saying that it was indeed part of the September changes.

On top of that, at the end of the day he did get you in that car, most probably with a nice, fat discount... which just eliminated any loss to you for his "deception".

The good news is... you can get that Combox retrofitted. Save the lawyers fees and just wait for the Combox kit to be available.

Hey, I saw one of the pics you posted showed Front PDC. If I install the BMW Front PDC, will it work?

Regarding the voice activated module. Are you saying that the old one will not work with the upgrade. I'm sure that's what it means, but just want to clarify.

Yes, both the front and rear PDC will work fine with the CIC after the coding.

The Voice Control is stored in the head unit, so if you remove the CCC the Voice Control will be gone. Then when you install the CIC the new Voice Control can be activated.

can you post a pic of what the dash part of the nav looks like? i thought on factory option navs the dash was one big piece. if it looks factory i'll be interested in your retro.

You need a cable and laptop. He codes your car using your laptop... remotely. He did mine and I couldn't be happier with the outcome.
