Technically, no. But IF they issue you a termination letter, it should state if they allow you to collect unemployment or not.

If you are fired, you are fired...they will not fire you unless they have sufficient cause and have built a case. If they do, you get nada..no severance. If you are fired for misconduct you may not be eligble for unemployment either.

If they lay you off, severance is optional. Layoff does not equal being fired, you can call it a nice way of being fired, without cause. Severance is optional, unemployment is collectable.

You can disput anything in court, unfortunately the burden of proof will be on you...they have built their case. Hopefully (if it comes to this) they just do the right thing and let you go for "reduced need for services" or something along those lines. Remember, unemployment still is a cost to them...it all depends how big of an a-hole they want to be.
