Good news!
Accidentally came across some smoked ones shown installed in an old thread on an European E90 (on a Montego Blue also!) It was available on some German site, and looks EXACTLY the same as the ones on EAC, Adamaster, **********s, BavarianX, and JLeviSW. Probably the same manufacturer with different distributors, like Eagle Eyes LED tail lights were for the E46. Maybe someone from JLevi can confirm. So far, the LED brakelights look quite bright, even in daytime. Compared to the OEM blacklines, they look just slightly less smoked in both the top and lower parts. Here they are:

I got them and sent them back.
Not that anything was 'wrong', but I found them kinda cheap looking: - no rear reflectors - no 'side light', just red glas/plastics See Pics: Compared to original: Let me know if you have any questions. A.

Also from previous pics, we can see that the 3 horizontal light tubes do not wrap around the side like the OEMs. However, if you look at the 2009 LCI pics, you'll see that the new light tubes will not wrap around as much as before. This is most likely due to the turn signal LED's physically taking up more space than before. So, if you look at the new tail lights from the side, it looks quite similar to the JLevi ones. Also, what did you think of the quality of the tail light itself compared to OEM, in terms of plastic, construction, etc?

Just to clarify on the DOT approval, these come with stick on reflectors that you can add to the bumper to comply with DOT reflector regulations. However, I think they are a bit unsightly and should only be added during inspections

There is a 2009 E90 LCI press video floating around on youtube that shows the turn signals blinking about half way thru. It blinks amber thru the red housing for the euro, but I'm not sure whether NA will get that also or, if I had to bet, most likely red as we currently have.

I still don't know... I like the smoked LED tail lamps, but it would be nice if the 3 light bars were LED (like on the 5 series) and the turn signals were LED as well. For now, I still like the black line tail lights bettter. They're still very European looking look great in day or night with the lights on or off. Black Lines have been the best looking mod so far for the rear of the E90.

+1. Also, none of these after-market LED tail lamps continue the lighting on the sides, like the OEM ones (Black Line included). The 3 light bars should be LED (or like the all the other newer BMW's now - X, 5, 7 series and I think the E92's) and wrap around to the sides as well.
