It's the insirance companies perogative who inspects the vehicle. However there's no reason you can't get an estimate from an authorized BMW repair facility. Is the car a lease or still financed? If so BMW is very picky about repairs especially leased vehicles, could use that pressure for a better settlement from the insurance.

Similar shit has happened/happens with the ladies in my family. Women just blank out during emergencies, its like their brains turn off. I've learned not to trust my cars with anyone. I hope your wife doesn't have any critical injuries. Just relax and forget about it. At the end of the day its just a car... I mean cars.

While I can certainly appreciate your pain and the hassle of this whole situation (and I agree you should give the captain a piece of your mind) always remember life could be a lot worse and that this is really a very minor bump in the road. This was my first thought when I saw in your first pic just how damn cute your daughter "Nike" is. It also goes to show how very important child seats are. Really happy to hear no one was seriously hurt and good luck getting everything back in order. You just may need a performance exhaust and m-tech bumper now...

The insurance can demand their inspector, but they can't dictate who repairs the car. It doesn't have to be one of their "approved" shops. You can take the car wherever you feel comfortabel getting it repaired. Don't let them try to tell you otherwise. They will pay for the repairs to be done right, but it may take some arguing.

Since she was rear ended, and you have witnesses saying the guy was tailgating, it is ENTIRELY his fault. (Which is usually the case when anyone rear ends somebody).

His insurance will have to foot the bill. Don't let them screw you, insist on getting it repaired at the shop of your choice, not theirs. Does your dealer have a BMW Certified shop? If they do I would just take it there. They will send an appraiser out to your shop to make estimates and approve repairs. Technically you're not allowed to have the dealer start tearing down your car or anything, obviously until the appraiser gets there.

Sounds like the cop was a real bitch. Hopefully she doesn't cite your wife for being in the wrong (cutting off and "illegal tint"). If he is indeed "at fault" you should have them by the balls.

If this is your first loss on the 335, I'd look into Diminished Value and hiring a Diminished Value Consultant as well.

Your daughter is beautiful man!
Well from the sounds of things, maybe she got on here saw your "Drives:" notation and decided to take it outa your cars ass! hahaha

Nah but listen man it isnt the end of the world, my wife backed into my car twice in the past 3 months and I finally am getting both area fixed. Car is in the shop right now getting the dr rr door fixed and repainted and the dr side fr bumper, headlight, and fender repaired and painted! I know it sucks but her insurance covered it all and she had an accident forgiveness so her ins wont get hurt.

At the end of the day, it is just a car and my wife is my beautiful wife who I love and adore, she was more upset than me, so It was hard to get mad at her!

Good luck with everything bro!

It's the same old story. Wives/daughters/sisters/aunts/girlfriends, etc. crashing our beautiful cars... Yet for some reason, they still have lower automobile insurance rates than us!

Not sure about where you are, but here when some tard rear ended my car I was able to take it anywhere I want and the insurance would deal with the shop directly. I took it to the dealer.

Maybe because when they crash they rip off a bumper, dent a door etc. When we crash we roll it 5 times and total it.

That's probably true. However, I’d venture a guess that the overall dollar value of their numerous (minor) accidents surpasses the dollar value our less frequent (major) accidents!

Diminished value is the loss that your car will take now that's it's been in an accident. Now matter how well your car ends up being repaired, the wreck will still show on on Carfax, people will always know that it's been wrecked, and it will stay with the vehicle for it's entire life cycle. Because your car has now been in an accident, it's is considerably worth less than it was before the accident.

Diminished value laws vary from state to state, but the at-fault party is responsible for your entire economic loss, including both repairs to your vehicle as well as the "diminished loss". Sometimes the diminished loss can equal the costs of your total repair ($7,000+). I'm not saying that's what it is in your case, but it is at least worth checking out.

I will tell you that because of this accident your car can never be CPO'ed, obviously this will have a significant impact on your resale and overall vehicles value.
