This must be frustrating, but hang in there I think. Although your circumstances might be different. Personally, if I could get the car sometime between end of March and before May I would be ok with it (not best pleased but ok). A few weeks delay isn't that much of a deal (it isn't uncommon, all but 2 out of 5 cars I've ordered so far this calender year, from different manufacturers have been delayed - no I'm not buying VAT free!!!).

Though if an order is delayed by up to 12 weeks from estimated delivery, you will be well within your right to demand a refund.

Unfortunately according to your contract, I do not think that change in dates is enough of a delay to be able to cancel your order and for them to refund the deposit. It also sounds like a build slot is now committed for your order.

I can also confirm what Irubrukid said, most builds fell behind by 2/3 weeks at least and I believe this is due to some sort of scheduling at the factory.

Quoting this from the BMW purchase contract/order form:

"2. DELIVERY

(a) The Seller will use his best endeavors to secure delivery date or dates, but shall be under no liability whatsoever for loss occasioned by delay in delivery arising out of any cause beyond the control of the Seller.
(b) The Goods may be delivered by the Seller in advance of the estimated delivery date upon giving 14 days prior to the notice to the Purchaser;
(c) If the Goods are not delivered within three calendar months of the estimated delivery date the Purchaser or the Seller may elect by notice to the other party to cancel this Contract. Upon such cancellation the Purchaser's deposit shall be returned and the Seller shall be under no further liability to the Purchaser;
(d) Delivery shall be deemed to have been made on the date that the Goods are made available for collection by the Purchaser and the Seller has given notice to the Purchaser that the Good are ready for collection."

Basically means, yes you could cancel your order, but be prepared to loose your deposit.

Like many others have said, Anneka will get you a straight answer (though I don't think she will be able to order your car any quicker because they are also in BMW's hands).

flyfs6 cheers for the info mate..was reading the exact same thing just before read your post.. i think on this occasion it will be matter of just sitting tight well at least until monday to see what comes of it..

a few weeks give or take is fine..however when you are talking of up to 6-7 weeks its frustrating to say the least..

lets see what Monday brings!!

Anneka will help you out. What you really need here is an understanding of why the build slot has slipped and some comfort on an actual build date.

You could argue, I'm sure successfully, that the contract contains "unfair terms & conditions". A three-month delay of an estimated date, which was already 6 weeks from the date of your order, is not reasonable and would not be considered so by anyone.

If you want out, tell them and ask them to return your deposit within 14 days - failing that you'll recover it through the small claims court.

That's one of the funniest things I've heard said by a salesman in years. What date is it today? 26th, umm, and it hasn't started being built yet? Ridiculous assertion. Once built, I think you're looking at a minimum of 2weeks for the car to arrive at the dealership.

The same thing happened to me two years ago when I bought my car (Sytner dealer). I ordered in March and was desperate to get it by the summer (it is an e93!), as we planned to drive it down to Spain. Like you it kept getting put back for all sorts of reasons - shortage of 19inch wheels etc. In the end I spoke with BMW UK and they were able to find get a build date that was 2weeks earlier than the latest estimate given by the dealer. Eventually received the car mid-July, just in time for the sunshine

Seriously, hopefully Anneka will sort this out for you.

All these issues with Sytner are getting tiresome to read. Its great that Anneka and are here to help, but why does it come down to this so often? If the franchise offered good service in the first place, then Anneka - no offence but your job wouldn't be required?

I don't see even 1/10th as many "anti dealer" posts about any other dealership than I do Sytner.

Hopefully it is all improving? It does seem to be? .. But the OP's first message - that the sales guy basically just said "nothing you can do, accept it or lose your deposit. Tough" is to me so so so so completely out of order for anyone to say to someone parting with the best part of 40k on a car. Some respect is in order surely. The salesman in question should be reprimanded as he's (and a few select others in the London network I'm sure) making the franchise look bad.

Meh.. Sorry, not a flame / dig at anyone in particular. I just think we need to put this in perspective. We can't be here saying Sytner are amazingly good etc etc etc because they resolve all these customer complaints personally on here. The complaints would not exist in the first place if the service level was good.

True, but to be fair I expect Sytner have the largest number of dealers in the most populated areas. Odds are they'll have more customers in the pot for things to go wrong!

And there will ALWAYS be disgruntled customers no matter how hard you try. An Anneka is therefore always needed - but often not someone you can get to talk to.

Big points to Sytner for putting her at the forefront of us lot!

And big points to Anneka for responding accordingly and taking the flak so professionally.

To add to it, I think its as simple as, we hear about Sytner more often both good and bad, because people now know that Sytner are on this forum. People put things in public domain hoping for a beneficial response (if one is generated). I doubt the OP didn't notice that Sytner are a forum sponsor.

E.g. You're probably less likely to rant about something someone else did, when you know they'll never see it and if there is no mileage in complaining other than telling people what happened.

Also, I think if everyone knew how much bullshit people make up in their stories, a lot of us would be surprised!

The OP seems like someone with a genuine issue though, and I'm sure they will help him as much as they can.

None taken , we are improving but since we're on the subject...

After speaking with jattx earlier, I spoke with the sales manager who was incredibly sympathetic and we spoke briefly regarding a possible resolution. If our avenue's of communication were a little clearer we may have saved jattx the worry that made him turn to the forum for advice, so I sincerely apologise for this.

Regarding this car, we unfortunately don't have control over build times and the LCI E92 has been so popular world wide, that BMW have a back log. Unfortunately, our Sales Manager wasn't aware of the unhappiness that has been caused in this particular case, and now that he is, aims to do something about it.

I have to say a big thank you to anneka for sorting this out prompetly..having spoken to the new sales manager at the dealership we are discussing the options available to me at present !! there is light at the end of the tunnel..

so a big thanks to anneka its much appreciated the effort and help and advice you have given!!
