Thanks for the suggestions everyone. I'm going to contact them again and try to resolve the issue this week. It took a week for me to even talk to the seller the 1st time!! I kept being passed around to other employees at the delearship. I live in Charleston, SC and the delearship is in New Jersey, so it's hard for me to get a response from them since the attempted contacts aren't face-to-face. Here is the listing for the car on their website:

It does seem they have a few credibility issues. Milegae stated is different from what is on the odometer and carfax.

If it were my money I would walk, leave the negative feedback on fleabay, call the NJ BBB and file a complaint, contact the FTC and file a complaint. The blemishes on their report card will not only warn other consumers about this dealer, but it will also cost them a lot of $ in lost sales. Do not let the temptation of a perceived good deal blind you into pursuing something that may turn out to be a nightmare.

Looks '09 to me....mirrors don't change until LCI I think.\

What's wrong with 11K....In a year and change?

I hit 50k this past winter and I am about to hit 60K this winter....about 300miles actually so I'll probably be right at 11K for this year.

I agree with this. Get a lawyer. It will take one letter/call for them to give in. Its a lot cheaper to give you the car for a loss than to pay a lawyer to defend themselves in court.

Same thing happened on M3Post a while back, I dug up the thread for you: http://www.m3post.com/forums/showthread.php?t=127993 - read it a while ago, but can't remember all the details. Maybe there's some useful information there though. Sending to Autoblog and/or Jalopnik is a good idea too. Dealers hate bad publicity.

I would get a lawyer and tell the dealer to get bent. The price obviously isn't that far off (not like you won it for $250). So if they didn't get exactly what they were looking for, tough luck. That's how eBay works. They need honor the auction and sell you the damn car.

this happens a lot. ebay wont do anything for you. you'll have to laywer up and even then its still up to the dealer to want to work something out with you. sometimes they do to stop the negative pr, sometimes they still dont care. but its definately an uphill battle. sometimes i wonder how ebay can get away with not legally honoring thier sales, but whatever...

ebay is just an intermediary. the only one liable is the dealership not ebay. By using ebay the dealership has entered a legally binding contract but beyond that if they don't do their part it is up to a court to enforce the sale. That said I'm surprised autoblog/jalopnik haven't jumped on this yet, they usually love stuff like this.

They're a high end dealership in Jersey that is generally highly regarded. They keep quite a few exotics on their lot at all times.

i think i'm the only one that doesn't agree with you on here. if there is a $10k difference in the asking price and the value of the car then the dealership may have made an honest mistake.

come on now.

recently at the liquor store around the corner i saw a really nice bottle of tequila on the shelf with a sale tag advertising it for $40. i thought that the price was too good to be true but i attempted to buy it anyway just in case they had a reason to get rid of it for cheap.

the clerk immediately realized that it was a mistake (retail price is around $75) but she called the owner to ask if they could meet me on the price. since i knew that the value was $75 i accepted their good faith offer to sell it to me for $55, it being a great deal still. never for one minute did i think that they had any obligation to sell it to me for $40.

can you really get a 2009 335i for $25k? i think you know better. unless there IS something seriously wrong with the car then my opinion is that you should move on if they wont compromise with you.

IDK, i'm probably alone thinking that honesty is a 2 way street.

Legally that's a binding sale, it might have been their mistake to list the car at 25,000 but it was still an open offer and you acted on it. You had no clue that it was a mistake and they shouldve double checked the price before listing it. Legally, they have to honor it..congrats on the new car

Every dog has its day man. While it may have been a "mistake", the salesperson or management should have caught it and canceled the auction. Its the dealers fault for listing an item valued ~30k and not having the intelligence to monitor it or the market in which they are advertising. Let this be a lesson to that dealer to get their shit in order and start responsibly managing their product. In no way is this situation bad on the bidder. He saw a great deal (which is the premise of EBAY) and bid on it.
