The reason BMW (and any car company) doesn't do this is simple. Reliability and maintenance.

The easy way to explain this is that your standard engine from BMW is maybe running at 65-75% efficiency depending on the model and tune and the like. The engines are perfectly capable of 100% or even 110% efficiency, meaning more power and better fuel mileage, but the problem is the chance that parts will fail is much higher than at lower efficiency ratings. Since most of BMW's buyers will probably only do standard factory maintenance, and a small percentage will barely even do that, BMW "builds in" a level of protection to make sure the engines last as long as possible. Usually this is all done at the ECU tuning level. That's where a guy like Shiv comes in. He programs the ProCEDE to supersede the ECU's natural tuning for more aggressive fuel and air maps. Most off the shelf tuners will bring the engine to maybe 90% efficiency, and if you do a dyno tune with Shiv you could get maybe 95% out of it.

This is true of just about ALL vehicles. That's why tuning programs like the ProCEDE take so well on vehicles with little side effects. Most people who run a ProCEDE are going to take good care of their car and will almost never see a reliability problem, most also accept that there's risks with tuning. If BMW was to start shipping cars with 80-90% efficiency, warranty claims and cost of maintenance would skyrocket, costing BMW more in the long run.
