Anyway you are correct. After that build date there were not many additional 335d brought into NA. SA's input:
"Sir, your car already carries from factory the solution provided by the first EGR recall campaign. This current SW release is apparently not compatible to cars in this situation. BMW will contact you when a solution is available. Your car is perfectly fine as is and BMW will honor its mechanical integrity in case any issue arises from this event."
