but a car would pass with a bms fix? is it also possible to run both?

Yep, will pass with BMS fix... you would have to run stock map at inspection. I hear it's not good to run both at the same time as the BMS Fix is "tricking" the ECU. I know a couple people have run both but I wouldn't.

and is the bms fix easily uninstallable? you know just for inspection use

As long as you can get under your car and take the plastic panel off it is easy. It just screws on where the o2 sensor goes and the o2 sensor screws into it and reverse to take off.

Thinking about getting these bit hear that the install is a real PITA since you have to drop the subframe? Is this true and if so what am I in for?

Well my best friend is a seasoned mechanic and he has installed and uninstalled downpipes on 2 of my 335Xi and Xdrive coupes and it is still a royal pain in the ass. Its just time consuming and you must have the correct tools. I would never do this in my backyard but I do know people who have.
