they arent a knock off company that copies other manufacturer parts and sell for a cheaper price. If you want Hartge, go buy Hartge. Duke Dynamics basically take OEM BMW designs and slightly modify them to fit the E92's.

with the vents being open, are they functional (ie: help release of hot engine air)?

You have it closed if you don't want the opening vents.
