Thats a big pill to swallow..

I wish you luck on getting the center to step up on this one --

the whole issue with the guy from BMWNA coming out does kinda show that the problem may be pretty serious (from their point of view) .. but I have yet to see a case when the "flight data" on these cars have been in error.. (not saying it 100% fool-proof -- but 99.9% of the time a judge see it ..)

if you do get a chance to see the docs related to the incident, it should contain the date, time, vehicle speed, engine rpm and other relevant data ..

to add a note - I'm sure BMW has fought this fight before .. so make sure you have all your duck in a row -- if you take up the fight.

That is crazy. Start looking into a lawyer that will go after them on the basis of contract violation. The contract being the warranty. They will need to prove your car hit 8800rpm with the computer info and prove that it was scanned on your car. I think they are just trying to see if you will cave. Dealers do not like using warranty for big ticket items like this because they do not get paid right away and it is usually a pain for them. Plus I was told they do not make as much money.

PLEASE tell what dealer. Dont let them give you the run around. What are the chances of picking the car up and towing it to another dealer?

What " black box " are they talking about anyhow? Tell them to show you where it says that. I know for a fact that they can print it out of the GT1.

black box ???

the is no real "black box" in the car -- but there is an event logging system incorporated in the DME --

In previous years if misuse/abuse suspected -- the dealer would have to remove the DME and send it to the engineering department of BMWNA or AG -- the engineers would extract the logged data and return the results.

I am gathering the new ISTA/P system is more advanced and allows quicker access to the information...

this is second hand information -- subject to validation

the stupid thing is if it really did rev to 8800 then that would mean 1 of 2 things. Either he has a tune or the ECU freaked out and let it go that high or is an improper readin. If that was the case then it is BMW's issue they have to fix.

it not likely - but you never know??

if he comes back with some numbers and circumstances -- it would lend more credibility - till there is a little more evidence than the pretty shallow story he pitched -- the jury is out --

8800k on these motors should float a valve and smack a piston -- at least... with 10:1 compression ratio the squish area is pretty tight ...

Definitely agree with the idea of not losing your cool when you go into the dealership - will be hard but will probably get you farther in the long run. Someone has mentioned valet parking - if they can provide proof of the over-rev with date I would definitely be cross checking that with where you were - if you had valet'd the car and that is where the over-rev occurred, BMW surely won't cover the warranty, but you might be able to go after the valet service. However, there are usually "use at your own risk" disclaimers on most valet tickets. GL and providing the name of the stealership would be great.

Sorry for taking so long to reply. I actually went to the dealership and spoke with the manager of the Service Dept. He was actually being really cool and we had a normal conversation. I did ask for all the service documentation and tried to find out exactly what was going on. He spoke with someone while I was in his office and now they said the RPM's hit 8161 Exactly(different from what the service advisor told me). Then he stated that the report he got from bmw was written in German. He told me to give him till tommorrow so he can do some research and find out exactly what is going on with the car.

The reason why I am not disclosing which dealership it is just yet is because I am still going through the process. Hopefully with the help I got from this thread I can go back and try to fight it with them and get them to cover this under warranty. However, if they do not work with me on this I will be disclosing exactly what dealership it is.
