Yes, unless they feel threatened by lawsuits nothing will happen.

I wish people would really read these boards before buying BMW's in record numbers.

The only way for me too keep the car if I see evidence that:
1. BMW has their shit together and come up with way to clean it without taking the engine apart
2. will be covered by the extended warranty that I might purchase.

Otherwise I will just get rid of the car as soon as my warranty expired. Might as well get used E90M3 that doesn't have this issue.

But you'll have still have to get a walnut blasting done on the M3 eventually. Not saying it's as bad as dealing with our shit.

Actually no. M3 is the last Non DI, no issues with carbon build.

They replaced my DEF and cleaned the intake at no expense to me. Also, gave me a $500 gift certificate.

I had a guy from BMW NA contact me back. He had no clue about our problems with the car, although I called a few months ago complaining about it. It falls on deaf ears.

The few times I've contacted BMWNA, they were not very helpful. I told them my issues, they had the local dealership run the codes, and because there were no codes, the issue was declared "normal". Even though the dealer tech was able to see the issue, replicate the issue, take video of the issue and have his shop foreman see/replicate the issue, nothing was done due to the lack of codes. I argued with them about it, and basically they said: no codes? nothing to fix.

Frankly, told you guys its a waste of time. BMW NA is not the right person to complain to. My complaint got published in NHTSA.GOV and it will go back to the eyes of the right people in BMW.
Hopefully more people share their technical complain there and it will get published too.

sent an email to matthew russel. can't believe all the problem with this emissions stuff. just got rid of an Audi Q5 because of possible carbon build up, now this stuff with the diesel. Maybe i should get the extended warranty - wonder if this stuff is covered?

NHTSA is not going to do a damn thing about your emissions issues....look how long it took them to catch 100+lives lost bc of faulty GM ignitions.

If anything - go EPA.

i'm happy to report that as a result of my email, I at least received a call this am from BMWNA in response and that they are going to follow my issues and report back with any tips/results. on the other hand, i'm sorry to say that again my SES light went off this morning and that now we have a catalytic converter failure - almost 30k miles and 2 weeks out of warranty. on a positive note, because the original fault was stored while the car was in warranty the dealer is working with us and offered to cover the parts and labor. Thanks BMW for helping and I hope this is the last of the SES light!!

I gather Matt came to bat cause I email him and said that you were directing the email to him. On another note Matt owns a 328 DIESEL so he is getting involved as I mentioned to him all the issue we hv I believe he is indirectly looking at our site

was just going by what the dealer was telling me in that they were going to cover the parts and labor. come to find out, I guess they should be as the warranty is 8yrs and 80,000 miles for the catalytic converter according to the manual. I guess that's why they offered

I got another call from BMW USA today. They offered to sell me the Gold extended warranty for 1/2 price. I don't see anywhere in the extended warranties that emissions equipment are covered. I'll have to find out the cost of that option and make sure i understand what is not covered.

I'm still leaning toward the Ecotune and Iaknown options...

I called BMWNA Tuesday and Wednesday to see what is going in with the Real Time Traffic Information. It has been stuck since Saturday.
They knew immediately who I am and what car I drive without me telling them anything in this regard.
The second time I called, the rep said "I see you called earlier".

They can see my info and what I call about, but there is no info regarding our complaints with the emission system??? WTF???
