It's petty, but it's on the books. The officer did make the act of handcuffing seem personal though. A good officer uses everything at his disposal to get the job done, but he should've swallowed his pride on that one and he should not have allowed the laughter to get to him in that scenario. Its interesting that the attorney in this video characterizes speed enforcement in the manner he does, but doesn't consider that speed is the primary collision factor in most crashes. It is a problem.

Or worse, you are collateral damage when they get T-boned if there are more than one lane in your direction.

Well technically he was detained (…and not free to leave) the moment he yielded to the cop's authority once the traffic stop was initiated, but I understand what you meant. I agree that the situation could've been handled much better.

If I pull to the side of the road, take my manual truck out of gear, may I legally then use my phone? Engine is still running.

Yep! You are not actively engaged in the operation of a motor vehicle at that time.

Are you saying that when I pull over I'm being officially detained? Doesn't that initiate a whole new set of rules? Miranda?

Is that only true because it's a parking/emergency lane? The "active traffic lane" is the determining factor here, right?
Yes! The fact that you are pulled over and not in a moving/active lane is what makes it okay.

Yes! Every traffic stop is a detention for everybody in the car (…even though the passengers may not be the subject(s) of an investigation; they are not free to leave). Miranda only applies once an arrest takes place (…e.g….custody) along with interrogation. I don't need to Mirandize you at all unless I plan to question you following an/the arrest.

That is correct. Open containers of alcohol are not allowed in a motor vehicle regardless of whether or not the vehicle is moving or parked (…23222(a) CVC and 23225(a) CVC).

Did that change for vehicles like vans/motorhomes, where the driver is deemed unable to reach the alcohol?
<Help, I'm driving and I dropped my beer, and it rolled to the back of the van>

Motorhomes are much more complicated because sometimes they are considered homes and are entitled to the same search & seizure protections as a standing home, and sometimes they are vehicles and the vehicular search and seizure laws apply.

Honoring one of our own this weekend.

The name of RCMP Const. Heidi Stevenson, who was killed in the 2020 Nova Scotia mass shooting, will be added to a monument for fallen peace officers at a ceremony in Halifax on Sunday.

A news release from Halifax Regional Police on Thursday says the event honours peace officers based in Nova Scotia who died in the line of duty. This will be the 40th annual event.

It is "is a humbling reminder of the selflessness and dedication of those who lost their lives while serving others," the release states.

Stevenson was 49 at the time of her death. She grew up in Antigonish and graduated from Acadia University in Wolfville with a science degree..

There will be a 12:45 p.m. parade from HRP headquarters on Gottingen Street in Halifax to the Nova Scotia Fallen Peace Officers' Monument at Grand Parade. A short memorial service will begin at 1 p.m.

Police officers in Canada have had a very bad time over the last few years. Two more executed just north of Toronto yesterday. Just so sad.

They're illegal in Nova Scotia too. Local LEOs have been catching 2 or 3 speeders a week for months now doing more than 50km over the limit. That's an automatic "stunting" charge... $2442. fine, 6 points, no license for 7 days and your vehicle is towed from the roadside and impounded for 7 days.
As an added bonus, you get to pay the tow charge as well as the impound fees and if you can't afford to retrieve your vehicle after the 7 days, well, the fun just keeps adding up.

I wouldn't simply because we don't run radar. I run a LIDAR gun when I use speed tracking technology. None of our patrol vehicles have radar units installed in them.

I'd hate to repeat a question you've probably already answered somewhere in this thread but just out of curiosity, how fast is your patrol car (top speed)?

Again, just wondering, not trying to race state issued vehicles or anything like that lol

Hmmm, good question. I don't think any of us have hit the speed limiter and department policy discourages going more than 25 mph over the prima facie limit. I think our patrol bikes are limited at 110 mph.

I don't see the point of a radar detector. I mean I get it, people want to speed and not get caught, but I see so many people have them that never do 5 over (5 over will not get you stopped here. "Usually" safe up to 10). Then I hear the reasoning "it's just nice to know they are there". Why? If you aren't doing anything wrong why does it matter if a patrol car is near?
